|a مرت الإنسانية في الآونة الأخيرة بمنزلق خطير شاع فيه استغلال الإنسان بكل عناصره من أعضائه وأنسجته في التجارة غير المشروعة بما يعود بالإنسان لعهود الاسترقاق والعبودية، مما دعا المشرع المصري إلى التدخل وإصدار القانون رقم 5 لسنة ۲۰۱۰ بتنظيم زرع الأعضاء البشرية المعدل بالقانون رقم ١٤٢ لسنة ٢٠١٧، وبعد ذلك صدر القانون رقم ١٦٤ لسنة ۲۰۱۰ بشأن مكافحة الاتجار بالبشر. وقد خلق هذا الوضع إشكالية في ازدواج النص التجريمي للإتجار بالبشر لأغراض تجارة الأعضاء البشرية، وكذلك ثارت مشكلة الإحالة للاتفاقيات والمعاهدات الدولية في مجال تطبيق هذه النصوص على جرائم الاتجار بالبشر لغرض تجارة الأعضاء البشرية.
|b Humanity has recently gone through a dangerous slide in which the exploitation of the human being with all its elements, including organs and tissues, has become widespread in illicit trade, which takes people back to the eras of enslavement and servitude, which called on the Egyptian legislator to intervene and issue Law No. 5 of 2010 regulating the transplantation of human organs, as amended by Law No. 142 of 2017. After that, Law No. 164 of 2010 regarding combating human trafficking was issued. This situation has created a problem in the double criminalization of human trafficking for the purposes of trading in human organs, and the problem of referral to international agreements and treaties has also arisen in the field of applying these texts to crimes of human trafficking for the purpose of trading in human organs.
