|a يهدف هذا البحث إلى جمع أهم القواعد الفقهية التي تتضمن معنى التيسير، وذكر أمثلة من تطبيقاتها في النوازل الطبية المعاصرة في مكان واحد؛ ليسهل الرجوع إليها، وإبراز أثر تلك القواعد في النوازل الطبية المعاصرة. وقد تضمن البحث تمهيدا في التعريف بالقواعد الفقهية، وبيان أهمية علم القواعد الفقهية، وبيان معنى التيسير. كما تضمن أربع عشر مبحثا في تطبيقات القواعد الفقهية المتضمنة للتيسير في النوازل الطبية. وسلك الباحث فيه المنهج الاستقرائي، وذلك بتتبع تطبيقات تلك القواعد في النوازل الطبية. ومن نتائجه المهمة: أن الشريعة الإسلامية متميزة بالسماحة واليسر ورفع الحرج، وأن قواعد التيسير الفقهية قد ساهمت في الكشف عن حكم الكثير من النوازل الطبية. ويوصي الباحث الباحثين في العلوم الشرعية باستكمال دراسة تطبيقات القواعد الفقهية المتضمنة للتيسير في النوازل الأخرى؛ كنوازل المعاملات المالية، ونوازل فقه الأسرة، ونحو ذلك.
|b This research aims to collect the most important jurisprudential rules that include the meaning of facilitation, and to mention examples of their applications in contemporary medical calamities in one place, to facilitate reference to them, and to highlight the impact of these rules on contemporary medical calamities. The research included a prelude to the definition of jurisprudence rules, a statement of the importance of the science of jurisprudence rules, and a statement of the meaning of facilitation. It also included fourteen sections on the applications of jurisprudence rules that include facilitation in medical calamities. The researcher followed the inductive approach, by tracing the applications of these rules in medical calamities. One of its most important results was that Islamic law is characterized by tolerance, ease and removal of embarrassment, and that the rules of jurisprudential facilitation have contributed to revealing the ruling on many medical calamities. The researcher recommends researchers in forensic sciences to complete the study of the applications of jurisprudence rules that include facilitation in other calamities, such as calamities of financial transactions, calamities of family jurisprudence, and so on.
