|a ارتبطت تقنية تفويضات المرفق العام بالتطورات السياسية والاقتصادية التي طرأت في الدول ومن بينها الجزائر، فالدخول إلى اقتصاد ليبيرالي تنافسي وظهور مفهوم الخوصصة، أظهر عجز الدولة عن تسيير مختلف أنواع المرافق العامة خاصة المرافق ذات الصلة بالنشاط الصناعي والتجاري، فمن الضروري إذن تقليص السياسة الاحتكارية الممارسة من طرف الدولة وتحرير المرافق العامة من طرق التسيير التقليدية والبحث عن سبل حديثة لتسيير المرافق العامة لضمان تلبية الحاجات العامة المتزايدة والمتطورة، وفتح المجال للمنافسة والمبادرة الخاصة لصالح فاعلين جدد عن طريق انتهاج تقنية التفويض في إدارة وتسيير المرافق العامة.
|b The technology of delegating public facilities was linked to the political and economic developments that occurred in countries, including Algeria. The entry into a competitive liberal economy and the emergence of the concept of privatization demonstrated the state’s inability to manage various types of public facilities, especially facilities related to industrial and commercial activity. It is therefore necessary to reduce the monopolistic policy practiced by Party of the state, liberating public facilities from traditional management methods, searching for modern ways to manage public facilities to ensure meeting growing and evolving public needs, and opening the way for competition and private initiative for the benefit of new actors by adopting the technique of delegation in the management and management of public facilities.
