المستخلص: ويعتبر عيب الانحراف عن الهدف من أخطر عيوب القرار الإداري، لأنه يرتبط ببنية مصدر القرار وصعوبة إثباته، مما يزيد من أعباء الشخص المتضرر من القرار الإداري. قرار إداري. إلا أن هذا الخلل لا يخرج عن إحدى الفكرتين: الانحراف عن تحقيق المصلحة العامة، أو الانحراف عن قاعدة تخصيص الأهداف. والذي هو محور بحثنا. تهدف الدراسة إلى توضيح مفهوم الانحراف عن السلطة، ومدى خطورته على حقوق الأفراد وحرياتهم، وشرح مفهوم قاعدة تخصيص الأهداف ومبرراته وعلاقته بالمصلحة العامة، ومعالجة أشكال الانحراف الإداري قرار الخروج عن قاعدة تخصيص الأهداف وكيفية إثبات هذا العيب أمام القضاء الإداري وعلى من يقع عبء إثباته. وما مدى صعوبة ذلك. كما تناولت الدراسة الضمانات التي يكفلها القانون للأفراد في حالة ثبوت انحراف الإدارة عن مبدأ الشرعية في القرارات الصادرة عنها. وتتمثل هذه الضمانات في إلغاء القرار الإداري المشوب بالانحراف عن الغرض المقصود منه، وتعويض الأفراد عن الأضرار التي نتجت عن القرار المشوب بالانحراف لأن القرار قد أضر بحق مشروع يضمنه قانون.

Which is the focus of our research. The study aims to clarify the concept of deviation from authority, the extent of its danger to the rights and freedoms of individuals, explain the concept of the goal allocation rule, its justifications, and its relationship to the public interest, and address the forms of administrative deviation, the decision to deviate from the goal allocation rule, and how to prove this defect before the administrative judiciary, and on whom does the burden of proving it fall. And how difficult is that.. The study aims to clarify the concept of deviation from authority, the extent of its danger to the rights and freedoms of individuals, explain the concept of the goal allocation rule, its justifications, and its relationship to the public interest, and address the forms of administrative deviation, the decision to deviate from the goal allocation rule, and how to prove this defect before the administrative judiciary, and on whom does the burden of proving it fall. The study also addressed the guarantees provided by the law to individuals in the event that the administration is proven to have deviated from the principle of legality in the decisions issued by it. These guarantees include canceling the administrative decision that deviates from its intended purpose, and compensating individuals for the damages that resulted from the deviant decision, because the decision harmed a legitimate right guaranteed by law.
