|a يهدف هذا البحث إلى تسليط الضوء على شرح في فقه العمليات وتطبيقاتها القضائية للفقهاء المغاربة المالكيين المتأخرين، وهو شرح "تحفة أكياس الناس في شرح عمليات فاس" للمهدي الوزاني على "نظم العمل الفاسي" للشيخ أبي زيد عبد الرحمن بن عبد القادر الفاسي، ويتناول هذا الشرح فقه العمليات أو ما يعرف بـ"ما جرى به العمل"، وهو تراث فقهي مالكي ظهر في الغرب الإسلامي متأثرا بعمل أهل المدينة في المشرق. تناولت هذه الدراسة شرح تحفة الأكياس بعمليات فاس، وبيان المنهجية الفقهية التي تناول بها الفقيه الوزاني شرحه للنظم الفقهي، واخترنا منه بعض النماذج التي رجح فيها عمل أهل فاس وإن خالفت المشهور من المذهب. ومن نتائج هذه الدراسة، الوقوف على أهمية الشروح الفقهية في تقريب النظم الفقهي وتبسيطه للمتعلمين وبخاصة في فقه العمليات، والدعوة إلى الاهتمام بالشروحات الفقهية، وبخاصة شروح المتأخرين لأهميتها في التطبيقات القضائية المعاصرة.
|b research aims to shed light on an explanation of the jurisprudence of operations and its judicial applications, by the late Moroccan Maliki jurists, which is the explanation of "Tuhfat akyās al-nās in Fez operations" by Al-mahdi Al-wazzani in explaining jurisprudential systems by Sheikh Abi Zaid Abd al-Rahman bin Abd al-Qadir al-Fassi. This explanation deals with the jurisprudence of operations, or what is known as mājara bihi al 3amal "what has been done", which is a Maliki jurisprudential heritage that appeared in the Islamic West, influenced by the work of the people of Medina in the East. This study dealt with introducing the explanation of Tuhfat al-akyās, defining the Fez operations, and explaining the jurisprudential methodology with which the jurist Al-wazzani dealt with his explanation of this system, and we chose from some examples, even if it contradicted doctrine. The findings of this study produced the importance of jurisprudential explanations, especially in operational jurisprudence, and the necessity of paying attention to jurisprudential explanations, especially the explanations of recent scholars, due to their connection to contemporary judicial applications.
