المستخلص: تعد القواعد الفقهية من الإرث العلمي الذي ورثناه عن العلماء السابقين، فهي تضبط الأحكام وتصنفها ضمن أصول وفروع، تجمع المتناثر منها تحت رابط واحد، مما يسهل فهم تلك القواعد، وإلحاق كل ما يستجد بأشباهها ونظائرها. ومن هذه القواعد قاعدة "الأمور" بمقاصدها هذه القاعدة العظيمة، التي أساسها قائم على النية، وقصد المكلف، وإنما مدار التكليف والجزاء والعقاب، مرتبط بشكل وثيق بالنوايا والمقاصد. يهدف البحث إلى شرح هذه القاعدة بالتفصيل مبينا معناها ودليلها والأبواب المتعلقة بها، والقواعد المندرجة تحتها ومستثنياتها، وبيان أثر القواعد من خلال التطبيقات الفرعية وآراء العلماء فيها. كما أجاب عن بعض التساؤلات المتعلقة بالقاعدة منها: كيفية الحكم على التصرفات اللفظية والفعلية، والترجيح بين الألفاظ والمقاصد عند التعارض وأثر النية في تغيير الحكم، وكيفية التمييز بين العادة والعبادة. وقد توصلت في بحثي إلى جملة من النتائج التي أظهرت أن جميع أعمال الإنسان وتصرفاته الفعلية والقولية تختلف نتائجها وأحكامها الشرعية المترتبة عليها تبعا لاختلاف قصد الإنسان ونيته ودافعه من تلك الأعمال والتصرفات وقد أوصت الدراسة إلى إجراء المزيد من الأبحاث المتعلقة بدراسة قاعدة الأمور بمقاصدها وإسقاطها على الواقع ومستجداته. وقد سار هذا البحث وفق المنهج الاستقرائي الوصفي التحليلي بشكل عام ولهذا جاء الاستقراء من باب التمثيل لا الحصر؛ حيث قمت بدراسة القاعدة من الكتب الخاصة المتعلقة بالقواعد، فعرضت الأقوال والآراء والمسائل منها.

Jurisprudential rules are one of the scientific legacies that we have inherited from previous scholars. They regulate and categorize rulings within origins and branches, bringing together the scattered ones under one link, making it easier to understand these rules, and to attach everything new to their similarities and analogues. Among these rules is the rule of “affairs with their intentions.” This great rule, which its foundation is based on intention and the purpose of the person charged with the task. Rather, the entirety of assignment, reward, and punishment is closely tied to intentions and purposes. The research aims to explain this rule in detail, explaining its meaning, its evidence, the sections related to it, the rules that fall under it and their exceptions, and the impact of the rules through sub-applications and the opinions of scholars on them. It also answered some questions related to the rule, including: How to judge verbal and physical actions, the weighting of words and intentions when conflicting, the impact of intention in changing the judgment, and how to distinguish between habit and worship. In my research, I reached a number of findings that showed that all human actions and behaviors, both verbal and physical, differ in their results and their consequent legal rulings depending on the difference in human intent, intention, and motive of those actions and behaviors. This research proceeded according to the descriptive analytical inductive method in general, and therefore the induction came from the perspective of representation and not limitation; as I studied the rule from the special books related to the rules, so I presented the statements, opinions and issues from them.
