المستخلص: هذه الدراسة بعنوان أثر بينة خبير الخطوط في الإثبات هدفت إلى تسليط الضوء على بينة خبير الخطوط باعتبارها من القرائن التي لها أهميتها في مجال الإثبات وتحديدا الجنائي وهي من البينات التي نص عليها قانون الإثبات السوداني وتتمثل أهمية الدراسة في إنها تعمل على دراسة بينة خبير الخطوط وما تواجهها من قوادح أمام المحاكم تقلل من قيمتها الإثباتية والإجراءات القضائية واجبة الاتباع متى ما أرادت المحاكم الاعتماد عليها في تأسيس الإدانة، وقد استصحبت الدراسة الأفكار القانونية التي وضعت لتقنين شهادة خبير الخطوط ومرجعية المحاكم في قبول شهادته من عدمها والأسس التي تقدرها المحاكم عند تأسيس الإدانة بناء عليها وذلك من خلال اتباع الدراسة للمنهج الاستقرائي والوصفي وقد توصلت الدراسة إلى نتائج عدة أهمها أن بينة خبراء الخطوط تربة خصبة للأخطاء إذ أن مضاهات الخطوط ما هي إلا بينة رأي، كذلك أن القضاء قد تعامل بحذر شديد مع بينة خبير الخطوط بخلاف بقية شهادات الخبرة التي يمكن أن تقدم أمامه ويرجع ذلك لأن القضاء أن بينة خبير الخطوط واهنة ولا تقوى على الصمود أمام قوادح الدفاع التي يمكن أن تصوب إليها، كذلك وان عدم انتماء بينة خبير الخطوط إلى تخصص علمي يمكن أن يتم تدريسه علما ومنهجا متكاملا كان سببا في ضعف وزن شهادة خبير الخطوط.

This study, entitled The Impact of the Evidence of a Scripting Expert in Evidence, aimed to shed light on the evidence of a font expert as it is one of the pieces of evidence that is important in the field of proof, specifically criminal, and it is one of the pieces of evidence stipulated in the Sudanese Evidence Law. The importance of the study is that it works to study the evidence of a font expert and what it confronts. Among the insinuations before the courts that reduce their evidentiary value and the judicial procedures that must be followed whenever the courts want to rely on them to establish a conviction, The study was accompanied by the legal ideas that were developed to codify the testimony of the calligraphy expert, the courts’ authority to accept his testimony or not, and the foundations upon which the courts evaluate when establishing a conviction on the basis of which the study followed the inductive and descriptive approach. The study reached several results, the most important of which is that the evidence of calligraphy experts is a fertile ground for errors, as The matching of lines is merely an evidence of opinion, The study was accompanied by the legal ideas that were developed to codify the testimony of the calligraphy expert, the courts’ authority to accept his testimony or not, and the foundations upon which the courts evaluate when establishing a conviction upon which the study followed the inductive and descriptive approach. The study reached several results, the most important of which is that the evidence of calligraphy experts is a fertile ground for errors, as The comparison of fonts is only opinion evidence. Likewise, the judiciary has dealt with the evidence of the font expert with extreme caution, unlike the rest of the expert testimonies that may be presented before it. This is because the judiciary that the font expert’s evidence is weak and cannot withstand the defense accusations that may be directed at it. Also, the fact that the evidence of the calligraphy expert does not belong to a scientific specialty that can be taught in an integrated science and method was a reason for the weak weight of the testimony of the calligraphy expert.
