|a لقد شكل انبثاق الميثاق الإفريقي لحقوق الإنسان والشعوب، نقطة البدا في تعاط إيجابي، مع قضايا حقوق الإنسان التي لم تكن من بين أولويات منظمة الوحدة الإفريقية؛ إذ أعطت اهتماما بالغا، لما تمليه الظرفية حينها، وهي قضايا أكثر إلحاحاً، كالتحرر من نير الاستعمار، ومنع التمييز العنصري وغيرها. إن هذا الميثاق يجد عالميته من المواثيق والإعلانات الدولية لحقوق الإنسان. ولا شك بأن عولمة حقوق الإنسان في ظل النظام الدولي الجديد، لم يكن هدفها تكرس عولمة الحقوق في بعدها العالمي، بل جاءت تكريسا لنظام دولي جديد؛ اتسم بطابعه الإنساني، والذي اتضح فيما بعد، أنه يهدف لإقامة نظام دولي يدار وفقا لمصالح الدول الرأسمالية، عبر آليات قانونية- سياسية، تستمد فحواها من روح البند السابع من الميثاق الأممي، الذي أعطى لمجلس الأمن الدولي سلطات واسعة، من أجل الحفاظ على السلم والأمن الدوليين.
|b The emergence of the African Charter on Human and Peoples' Rights was the starting point for a positive engagement on human rights issues that were not among the priorities of the Organization of African unity that paid close attention to what the circumstances dictated at the time, including the most urgent issues, such as protection against colonialism and the prevention of racial discrimination, among others. This charter finds its universality of pacts of international declarations of human rights and cultural and cultural heritage of the African continent. There is no doubt that the globalization of human rights under the new international order was not intended to perpetuate the globalization of rights in its global dimension, but rather the consecration of a new international order; was characterized by its humanitarian character which later proved to be aimed at establishing an international system, managed in accordance with the interests of capitalist states, through legal mechanisms, the content of which flows from Article 7 of the Charter of the United Nations, which granted extensive powers to the Security Council in order to maintain international peace and security.
