| 520 | |a تناقش هذه الورقة إشكاليات قانونية ترتبط بنوع جديد من الصحافة بدأ في الظهور والانتشار، إنها الصحافة الآلية، فبتطور الخوارزميات ونظام التعليم الذاتي، أصبحت الروبوتات قادرة على كتابة الأخبار وإعداد التقارير، لتظهر إشكاليات قانونية أهمها المسؤولية القانونية لهذا النوع الجديد من الصحافة. وبالحديث عن المسؤولية القانونية لابد من التحدث عن الشخصية القانونية للصحفي الروبوت، وكذا الحديث عن أركان جرائم صحافة الذكاء الاصطناعي، وبخاصة الركن المعنوي وبشكل دقيق القصد الجنائي في ظل غياب الركن الشرعي، خلصت الدراسة إلى ضرورة مواكبة التشريعات الإعلامية للتطورات التكنولوجية الخاصة في مجال الصحافة والتي ومازالت لم تعرف حدودها وآفاقها بعد. |b This paper discusses the legal issues associated with a new type of journalism that has emerged and spread: automated journalism. With the development of algorithms and self-learning systems, robots have become capable of writing news articles and producing reports, raising legal concerns, in particular the legal liability of this new form of journalism. When discussing legal liability, it is necessary to address the legal personality of the robot journalist, as well as the elements of crime in artificial intelligence journalism, in particular the moral element and, more precisely, criminal intent. In the absence of a legal framework, the study concludes that there is a need to adapt media legislation to technological developments in the field of journalism, which is still evolving with undefined boundaries and prospects. |d Cet article traite des questions juridiques relatives à un nouveau type de presse qui est apparu et s'est développé: la presse automatisée. Grâce aux algorithmes et aux systèmes d'apprentissage automatique, les robots peuvent écrire des nouvelles et rédiger des rapports, ce qui pose des problèmes juridiques, dont la question de la responsabilité légale de ce nouveau genre de presse. Lorsqu'il s'agit de responsabilité légale, il faut évoquer la personnalité juridique du journaliste robot, ainsi que les éléments constitutifs des crimes de presse en IA, notamment l'élément moral, et plus précisément l'intention criminelle. Sans l'élément juridique, l'enquête aboutit à la nécessité d'ajuster les lois médiatiques aux changements technologiques propres à l'industrie de la presse, dont les limites et les perspectives ne sont pas encore claires. | ||
