المستخلص: موضوع البحث: قاعدة الكتاب كالخطاب- دراسة تأصيلية وتطبيقات فقهية معاصرة "النكاح والطلاق" أنموذجا. أهداف البحث: الربط بين القاعدة الفقهية الكتاب كالخطاب وتطبيقاتها المعاصرة التي لها علاقة بالقاعدة. منهج البحث: يقوم منهج البحث على المنهج التكاملي المكون من: المنهج الاستقرائي والمنهج الاستنباطي، والمنهج التأصيلي. أهم تقسيمات البحث: يحتوي البحث على تمهيد: وفيه التعريف بمصطلحات عنوان البحث، وفيه خمسة مطالب، وعلى ثلاثة مباحث: المبحث الأول: أنواع الكتابة وحجيتها، وفيه ثلاثة مطالب، والمبحث الثاني: التطبيقات الفقهية المعاصرة للقاعدة فيما يتعلق بالنكاح، وفيه أربعة مطالب. المبحث الثالث: التطبيقات الفقهية المعاصرة للقاعدة فيما يتعلق بالطلاق، وفيه ثمانية مطالب. والخاتمة: وفيها أهم النتائج. أبرز نتائج البحث: • يشترط في الكتابة حتى تثبت بها الأحكام، وتكون حجة يعمل بها شرطان: أن تكون الكتابة مستبينة، وأن تكون الكتابة مرسومة. • يستثنى من قاعدة الكتاب كالخطاب الأمور التالية: النكاح، والسلم، والصرف. • الوقوف على عدد من المسائل الفقهية المعاصرة المتعلقة بالقاعدة فيما يتعلق بالنكاح والطلاق.

Research objectives: Linking the jurisprudential rule of the book, such as discourse, and its contemporary applications that are related to the rule. Research method: The research method is based on the integrative method consisting of: the inductive method, the deductive method, and the original method. The most important divisions of the research: The research contains an introduction: it introduces the terms of the research title, and it contains five demands, and three sections: The first section: types of writing and their authority, and it contains three demands, and the second section: contemporary jurisprudential applications of the rule with regard to marriage. It contains five demands. The third section: Contemporary jurisprudential applications of the rule regarding divorce, and it contains eight demands. Conclusion: It contains the most important results. The most prominent results of the research: • Writing is required in order for the rulings to be proven, and for it to be an argument that fulfills two conditions: that the writing be clear, and that the writing be drawn up. • Excluded from the rule of the book are the following letters: marriage, peace, and exchange. • Identify a number of jurisprudential and contemporary issues related to the rule regarding marriage and divorce.
