|a فكرة البحث تتكلم عن المسؤولية بوجه عام، ويراعي فيه الجذور التاريخية في اختلاط العقوبة بالتعويض ومن ثم انشطار المسؤولية... والآن العودة لفكرة التعويض العقابي والموجود اثرها في الحضارات القديمة.. وتجذر الخلاف حولها في الفقه اللاتيني على خلاف القانون الإنجليزي الذي يأخذ بها ويطبقها.. والجدل القائم حول وجودها أو عدم وجودها كفكرة في القانون الفرنسي، يمتد أثره ليطال القوانين التي تأثرت بالفقه اللاتيني ومنها القانون الليبي... ومن هنا جاءت هذه الدراسة لتحديد مفهوم التعويض العقابي والجذور التاريخية للفكرة، ومدى ملائمة الأخذ بها في القانون الليبي، أو البحث في ثناياه عن تطبيقات لهذه الفكرة.
