|a إن البحث في جريمة الدخول غير المشروع للحاسبات والأنظمة والشبكات المعلوماتية وفقًا لأحكام القانون رقم 5 لسنة 2022م بشأن الجرائم الإلكترونية، التي يعاقب عليها القانون في صورتها البسيطة متى توافرت شروطها من حيث نظام الحماية الذي ثم اختراقه عمدًا دون إذن، ودون أن يحدد آلية معينة للاختراق أو يشترط صفة معينة في المعطيات التي تم اختراقها، فيستوي أن تكون خاصة بأفراد أو مملوكة للدولة؛ وذلك لما لهذه المعطيات من قيمة اقتصادية أو لأهمية ما تحمله من معلومات، ما يؤكد رغبة المشرع في إسباغ الحماية على المعطيات الإلكترونية، تشديد العقوبة لمجرد دخول الجاني بقصد الإضرار بالبيانات، والزيادة في التشديد إذا تحقق هذا الضرر.
