|a يعتبر موضوع استرجاع الأموال المتحصلة عن جرائم الفساد أحد أهم التحديات التي تواجه الدول التي ارتكبت فيها هذه الجرائم، خاصة عند نقل هذه الأموال خارج إقليمها. فلا شك أن مكافحة ظاهرة الفساد والجرائم المرتبطة بهذه الظاهرة يفرض ألا تقتصر مكافحتها وملاحقة مرتكبيها على الصعيد الوطني، بل يقتضي تظافر الجهود الدولية لمواجهة هذه الظاهرة واسترجاع أموال العائدات الإجرامية، وفقا لاستراتيجية تعاون قانوني وقضائي بين الدول لاسترجاع العائدات الاجرامية من أموال الفساد تجنبا لإفلات مرتكبي جرائم الفساد من العقاب والحد من هذه الجرائم ومكافحتها. وفي سبيل تحقيق هذه الغاية، حرصت اتفاقية الأمم المتحدة لمكافحة الفساد المبرمة سنة 2003 على تنظيم موضوع استرداد العائدات المالية لجرائم الفساد أهمية كبرى وجعلته حجر الزاوية في التعاون القضائي الدولي في مجال مكافحة الفساد وملاحقة مرتكبيه.
|b The issue of recovering funds obtained from corruption crimes is considered one of the most important challenges facing countries where these crimes were committed, especially when these funds are transferred outside their territory. There is no doubt that combating the phenomenon of corruption and the crimes associated with this phenomenon requires that combating it and prosecuting its perpetrators not be limited to the national level, but rather requires concerted international efforts to confront this phenomenon and recover criminal proceeds funds, in accordance with a strategy of legal and judicial cooperation between countries to recover criminal proceeds from corruption funds. To avoid impunity for perpetrators of corruption crimes and to limit and combat these crimes. In order to achieve this goal, the United Nations Convention against Corruption concluded in 2003 was keen to regulate the issue of recovering financial proceeds of corruption crimes with great importance and made it the cornerstone of international judicial cooperation in the field of combating corruption and prosecuting its perpetrators.
