This study addressed a very important topic, namely the authority of the employer to modify the employment contract in Algerian labor legislation, because the stability of labor relations is necessary to achieve sustainable social and economic development. In this regard, the employer may abuse his right to modify the terms of the employment contract, which may harm the interests of the worker, which is why the legislator must intervene to clarify the legal rules allowing recourse to the modification of the employment contract, with the aim of balancing between the interest of the employer and that of the worker, and the need to activate the role of the labor inspectorate. Cette étude a abordé un sujet très important, lié à l’autorité de l’employeur au modifier le contrat de travail selon la législation algérienne du travail, car la stabilité des relations de travail est nécessaire pour parvenir à un développement social et économique durable. À cet égard, l'employeur peut abuser de son droit de modifier les termes du contrat de travail, ce qui peut nuire aux intérêts du travailleur, c'est pourquoi le législateur doit intervenir pour clarifier les règles juridiques permettant de recourir à la modification du contrat de travail, dans le but d'équilibrer entre l'intérêt de l'employeur et celui du travailleur, et la nécessité d'activer le rôle de l'inspection du travail. |
