|a في ظل غياب نص قانوني ينظم عمليات التحويل الجنسي في الجزائر، على اعتبار أن هذا النوع من العمليات محرم شرعا، وأمام قلة البحوث الفقهية حوله، يتعين طرح هذا الموضوع من الناحية القانونية وكيف يتصدى لهاته العملية، وخصوصا مع تجريمها في تشريعات مقارنة، رغم وجود تشريعات أخرى أباحتها لأنها تعنى بصراع وألم نفسي للشخص الراغب في تغيير جنسه بواسطة العملية الجراحية، ولا تُعنى بالصراع والألم العضوي، وإن كان الجزائر تعرف ندرة في إجراء هاته العمليات داخلها، لكونها بلد عربي إسلامي يتحفظ شعبه في التعبير عن اضطراب الهوية الجنسية، فإنه نادرا معه ما تظهر هاته الحالات للعلن، ولكن هذا لا يعني معه ترك هذا النوع من العمليات بمعزل عن القانون والاكتفاء بالقوانين العامة لتنظيمها.
|b In the absence of a legal text regulating sexual reassignment operations in Algeria, given that this type of operation is forbidden by law, and in the face of the lack of jurisprudential research on it, this issue must be raised from a legal perspective and how to address this operation, especially with its criminalization in comparative legislation, despite the existence of legislation. Others allow it because it is concerned with conflict and psychological pain for the person who wants to change his gender through surgery, and is not concerned with conflict and physical pain. Although Algeria is known for the scarcity of performing these operations within it, because it is an Arab Islamic country whose people are reticent to express gender identity disorder, it is rare with it. These cases appear publicly, but this does not mean leaving this type of operations in isolation from the law and relying only on general laws to regulate them.
