|a لما كان ما يصدق على أي نظام قانوني من حيث حتمية ظهور المنازعات بين أطرافه، يصدق على العلاقة الاستثمارية بين الدولة المضيفة والمستثمرين الأجانب، فالعلاقة ما بين المستثمر الأجنبي والدولة المضيفة وان ظهرت حسنة في بدايتها إلا أنها سرعان ما تتبدل نتيجة لتعارض المصالح بين الطرفين لتؤدي إلى عدم الالتزام بشروط الاتفاق المبرم بينهما، والخاص بإقامة المشروعات الاستثمارية في إقليم الدولة المضيفة. ولذلك فأن من أولى الأمور الضرورية في تشجيع الاستثمارات الأجنبية الخاصة، تحديد الطرق والوسائل الملائمة لتسوية المنازعات التي يحتمل نشوؤها في مثل هذه العلاقات القانونية المشوبة عامة بعنصر أجنبي. إن طول فترة التقاضي أمام المحاكم وارتفاع تكاليفه أيضا عند اللجوء إلى القضاء العادي قد أدى إلى ظهور مفاهيم جديدة لحل النزاعات بين المتخاصمين، منها مفهوم الوسائل أو الحلول البديلة لتسوية المنازعات (ADR) (Alternative Dispute Resolution) أو الطرق المناسبة لفض المنازعات كما تسمى في الوقت الحاضر (Appropriate Dispute Resolution) ويعبر عنها أحيانا بـ (فض المنازعات) Dispute Resolution (DR)، وهي وسائل أو عمليات مختلفة تستخدم لحل المشكلات أو المنازعات خارج نطاق المحاكم والهيئات القضائية الرسمية، مستفيدة من مزايا السرعة في حسم النزاع والحفاظ على السرية وخفض التكاليف في أوضاع كثيرة، إضافة إلى مرونتها من حيث إجراءات حل النزاع والقواعد المطبقة عليه.
|b Since what is ratified in any legal system in terms of the inevitable emergence of disputes between its parties, it is true of the investment relationship between the host country and foreign investors. The relationship between the foreign investor and the host country, even if it appeared good at the beginning, it quickly changes as a result of a conflict of interest between the two parties, leading to non-compliance with the terms of the agreement concluded between them, regarding the establishment of investment projects in the territory of the host country. Therefore, one of the first things necessary in encouraging foreign private investments is to identify appropriate ways and means for the settlement of disputes that may arise in such legal relations, generally tainted by a foreign element. The length of the period of litigation before the courts and its high costs when resorting to the ordinary judiciary have also led to the emergence of new concepts of dispute resolution between litigants, including the concept of alternative means or solutions to dispute resolution (ADR) (Alternative Dispute Resolution) or appropriate methods of dispute resolution, as it is called at present time (Appropriate Dispute Resolution) and sometimes expressed as Dispute Resolution (DR), which are various means or processes used to solve problems or disputes outside the scope of official courts and judicial bodies, benefitting from the advantages of speed in resolving dispute, maintaining confidentiality and reducing costs in many situations, in addition to their flexibility in terms of dispute resolution procedures and the rules applied to it.
