|a تبحث هذه الدراسة علم الفروق الفقهية حقيقته وعلاقته بالعلوم الأخرى في علم الفروق الفقهية من حيث حقيقة هذا العلم ونشأته وأركانه وموضوعاته وصلته بالعلوم الفقهية الأخرى. وكان من أسباب هذه الدراسة قلة الكتابة الشاملة في علم الفروق الفقهية كعلم من العلوم الفقهية، وحاجة هذا العلم للكتابة فيه بطريقة علمية واضحة ومبسطة. وكان منهج البحث هو الوصفي التحليلي، واختتم البحث بعدة نتائج من أبرزها حاجة الفقه لعلم الفروق الفقهية؛ فكلما ازداد جهد الفقيه والأصولي لبيان الفرق ولم يظهر له زاد قناعته في اشتراك المسائل مع بعضها ضمن القاعدة الأصولية أو الفقهية أو الضابط الفقهي، فإذا ما ظهر للفقيه الفرق المؤثر يكون سببا للاستثناءات من القواعد الفقهية، والاختلاف في الأحكام.
|b This study, titled “The Science of Jurisprudential Differences: Its Essence and Its Relationship with Other Sciences”, explores the field of jurisprudential distinctions in terms of its essence, origin, pillars, topics, and connection to other jurisprudential sciences. One of the motivations for this study is the lack of comprehensive writings on jurisprudential distinctions as a branch of jurisprudence, as well as the need for clear and simplified scholarly contributions to this field. The research followed a descriptive-analytical methodology and concluded with several key findings, the most prominent of which is the need for jurisprudence to learn jurisprudential differences. The more the jurist and jurisprudent work hard to explain the difference, and it does not appear to him, the more convinced he becomes that the issues share with each other within the jurisprudential rule. However, when a jurist identifies a significant distinction, it can justify exceptions to these jurisprudential principles and lead to differences in rulings.
