|a تناقش هذه الدراسة إشكالية العلاقة بين الفقه الإسلامي والقيم الأخلاقية، حيث تتمثل مشكلة البحث في دراسة وتحليل مدى استقلال الأحكام الأخلاقية عن الفقه وقدرتها على توجيه الأحكام الشرعية، وإمكانية أن تكون بديلا عن الفقه في مساحة معينة. وتخلص الدراسة إلى عدم إمكانية الاعتماد على الأخلاق وحدها كبديل عن الفقه لعدم وجود قانون أخلاقي خالص قابل للتعميم عبر الزمان والمكان، مقترحة تطوير آليات معاصرة للفقه تضمن تغطيته للمستجدات مع الاعتراف بوجود الفراغ التشريعي على مستوى الإثبات (الأدلة الفقهية) لا الثبوت والواقع، وذلك ليواكب التطور المعرفي والتقني دون التخلي عن دوره الأساسي في تنظيم حياة المجتمع.
|b This study examines the problematic relationship between Islamic jurisprudence (fiqh) and moral values, where the research problem focuses on studying and analyzing the extent of moral judgments' independence from fiqh and their ability to guide religious rulings, as well as the possibility of serving as an alternative to fiqh in certain areas. The study concludes that ethics alone cannot be relied upon as an alternative to fiqh due to the absence of a pure moral law that can be universally applied across time and space. It suggests developing contemporary mechanisms for fiqh to ensure its coverage of emerging issues while acknowledging the existence of legislative gaps at the level of evidence (jurisprudential proofs) rather than actual existence, thereby enabling fiqh to keep pace with cognitive and technical developments without abandoning its fundamental role in organizing society.
