المستخلص: In the past, criminology studies focused on the crime itself without paying attention to the perpetrator and the victim. The old traditional school called for setting uniform punishments for each crime without differentiating between one perpetrator and another, and did not give the judge any discretionary power in the area of applying the punishment. In a later development, the interest shifted from the crime as an act to the person who committed the crime, as a result of the emergence of the thought of the modern traditional school, which began to be interested in the human element in the crime represented by the perpetrator, and the victim remained outside the circle of its interests. With the principles of this school, the idea of the individualized punishment system and the impediments to criminal responsibility emerged.
