|a أصبح اللجوء للوسائل البديلة لحل النزاعات العمالية في وقتنا الحالي أمراً ملحاً، وذلك لتلبية متطلبات الأعمال الحديثة، والتي لم تعد محاكم العمل قادرة على التصدي لها بشكل منفرد. فمع التطور المستمر في عقود العمل، وما نتج عن ذلك من تعقيد في المعاملات، وحاجة إلى السرعة والفعالية في بث الخلافات وتخصصية من قبل من ينظر بهذه الخلافات أو يسهم في حلها، نشأت الحاجة لوجود آليات قانونية يمكن للأطراف من خلالها حل خلافاتهم بشكل سريع وعادل وفعّال، مع منحهم مرونة وحرية لا تتوفر عادة في المحاكم.
|b Resorting to alternative means to resolve labor disputes has now become an urgent matter, in order to meet the requirements of modern business, which labor courts are no longer able to address individually. With the continuous development in employment contracts, and the resulting complexity of transactions, and the need for speed and effectiveness in airing disputes, and specialization by those who look into these disputes or contribute to resolving them, the need has arisen for the existence of legal mechanisms through which the parties can resolve their disputes quickly and fairly. And effective, while giving them flexibility and freedom that is not usually available in the courts.
