المستخلص: إن التطور العلمي الحاصل اليوم في مجال التعامل مع الأدوية والعقاقير الطبية، فإن الأمر لا يخلو من أخطاء، سواء كانت هذه الأخطاء عمدية، أو خطئية، أو متجاوزة القصد التي قد تقع من أصحاب المهن الطبية كالصيدلي أو الطبيب عند وصف أو صرف الأدوية، ما يترتب عنها قيام المسؤولية الجنائية تجاه كل من قام أو شارك في الخطأ، وذلك عند قيام أي منهم بأفعال لا تتوافق مع التشريعات النافذة، والقوانين والأنظمة التي تنظم مهنتهم. إن مهنة الصيدلة كانت في البداية لصيقة بمهنة الطب، فإن التطور العلمي في العلوم الطبية دفع بالأطباء إلى التخصص، كل منهم في اختصاص طبي معين، حيث فصلت الصيدلة كتخصص مستقل عن الطب، فأصبحت تختص بتركيب الأدوية والعلاجات الطبية، وأصبح دور الصيدلي هو التعامل في مجال الأدوية وصرف الأدوية لمستهلكي الدواء، أما دور الطبيب يقتصر على الكشف عن المرضى وتشخيص حالتهم المرضية، وقيامه بوصف الدواء المناسب لهم عادة، وبصرفه أحيانا، ويبرز دور كل منهم في المجتمع في الحفاظ على الصحة والسلامة العامة وذلك بتجنيب الأشخاص الذين يقومون بوصف وصرف الأدوية لهم الأخطار التي قد يشكلها هذا الدواء على حياتهم وسلامتهم، ذلك باعتبار أن الممارسين لمهنة الطب أو الصيدلة هم أشخاص فنيون حاصلون على شهادات تؤهلهم لمعرفة خبايا الدواء وتأثيراته، وما يحتوي عليه من مخاطر متفاوتة قد ترتب آثارا جانبية، وتداعيات سامة، وعواقب وخيمة، خاصة إذا تهاون الطبيب في وصفها أو صرفها أو الصيدلي في صرفها. إن حماية منتجات الأدوية وطرق صناعتها لم تقف في الواقع عند حد إصدار قوانين جديدة لبراءات الاختراع أو تعديل القوانين الموجودة، وإنما اتسعت نحو تدويل قواعد الحماية من خلال إبرام معاهدة EPC وتعديلاتها، ومن ثم اتفاقية TRIPS حيث تم الاستجابة لمطاليب الشركات المنتجة للأدوية في الدول الصناعية، وأصبحت حماية منتجات الأدوية وطرق صنعها حقيقة ثابتة في مختلف الأنظمة القانونية، كما أصبحت دوائر براءات الاختراع في بلدان هذه الأنظمة مركزا رئيسيا لتزويد الأفراد والشركات والمؤسسات الأكاديمية بالمعاريف التكنولوجية وإيصال المعلومات وتوسيع آفاق المعرفة التقنية.
