|a جاءت هذه الدراسة للوقوف على موقف المشرع العراقي من الاتصالات الإلكترونية بين الزوجة وعشيقها من حيث التجريم والعقاب وما ينتج عنها من آثار تتعلق بأنها الرابطة الزوجية عن طريق الوسائل الإلكترونية ومن أهمها الاتصالات الإلكترونية الخاصة بالرسائل النصية وإرسال صور غير أخلاقية عن انفسهم والتعري أمام الكاميرات، ما هي إلا نتيجة لتحويل العالم إلى قرية صغيرة عن طريق تلك الشبكات العنكبوتية، ومع ذلك لم يتصد لها المشرع العراقي بصورة مباشرة وواضحة بالتجريم والعقاب بالرغم من تأثيرها السلبي على تفكك الأسرة، حيث تعد تلك الاتصالات من أهم الأسباب التي تدفع الزوج المتضرر في عصرنا الحالي إلى اللجوء إلى المحاكم المختصة لإنهاء الرابطة الزوجية.
|b This study came to stand on the position of the Iraqi legislator on electronic communications between the wife and her lover in terms of criminalization and punishment and the resulting effects related to the marital bond through electronic means, the most important of which are electronic communications, text messages, sending immoral pictures of themselves and nudity in front of cameras, which are nothing but a result of turning the world into a small village through these spider networks, and yet the Iraqi legislator did not address it directly and clearly by criminalization and punishment despite its negative impact on the disintegration of the family, as these communications are among the most important reasons that push the aggrieved husband in our current era to resort to the competent courts to end the marital bond.
