المستخلص: أسس ابن خلدون في مقدمته أن طرق التصنيف في "أصول الفقه" تنحصر في طريقة الحنفية التي جعلها أمس بالفقه، وطريقة المتكلمين، وتبعه المعاصرون فتجاوزا ما حدَّه ابن خلدون فأطلقوا على طريقة الحنفية مصطلح "طريقة الفقهاء"، وبقي هذا التقسيم يُتَناقل، علما أن من لوازمه أنه يجعل الإمام الشافعي وما صَنّفه على طريقة المتكلمين، مع كونه من أشد الناس إنكارا للكلام، فاحتاج البحث إلى تحرير المراد بمصطلح "الفقهاء"، وبيان أهم معالم مذهبهم الأصولي باستقراء المسائل الأصولية التي نُسبت إليهم، والكتب التي صرَّحت بانتمائها إليهم، كما صنع ابن السمعاني في كتابه "قواطع الأدلة". فجاء البحث في مقدمة، وثلاثة مباحث، وخاتمة. اختص "المبحث الأول" ببيان تمايز طريقة الفقهاء عن طريقة الحنفية، والمتكلمين، و"المبحث الثاني" في المسائل الأصولية التي انفرد بها الفقهاء عن جمهور الأصوليين، و"المبحث الثالث" في بيان أهم معالم المذهب الأصولي للفقهاء. وخلص البحث إلى أن "طريقة الفقهاء" في أصول الفقه هي على الحقيقة طريقة الصحابة والتابعين في استنباط الأحكام، وهي طريقة متقدمي الأصوليين قبل أن يطغى علم الكلام على مباحث أصول الفقه.

Ibn Khaldun established in his book that the methods of classification in the science of "Principles of Jurisprudence" are limited to the Hanafi method, which he made closer to jurisprudence, and the method of theologians. Contemporaries followed him and called the Hanafi method the "method of the jurists", and one of the requirements of that is to make "Imam al-Shafi'i" the method of theologians. The research clarified the meaning of the term "jurists", and clarified the most important features of their doctrine of the principles by inducting the principles issues that were attributed to them, and the books that stated their affiliation to them, as Ibn al-Sam'ani did in his book "Qawaati' al-Adillah". The research included an introduction, three chapters, and a conclusion. The first chapter was devoted to clarifying the distinction between the method of the jurists and the method of the Hanafi and theologians. The second chapter was devoted to the principles issues that the jurists were unique in from the majority of the principles scholars. The third chapter was devoted to clarifying the most important features of the principles doctrine of the jurists. The research showed that the “method of the jurists” in the principles of jurisprudence is the method of the Companions and the Followers in deriving rulings. It is the method of the early scholars of the principles of jurisprudence before the science of theology dominated the topics of the principles of jurisprudence.
