|a تتناول هذه الدراسة موضوعاً حيوياً من مواضيع القانون الإداري في الوقت الراهن، وهو موضوع التكييف القانوني لأثر جائحة كورونا على تنفيذ العقود الإدارية، فقد فرضت تلك الجائحة آثاراً غير مسبوقة في مناحي الحياة المختلفة، وعلى الأخص ما يتعلق بالعقود الإدارية المبرمة من جانب المرافق العامة لضمان استمراريتها، وهو ما أثار جدلاً قانونياً بهدف الوصول إلى إسباغ التكييف القانوني الملائم لأثر جائحة كورونا على تنفيذ العقود الإدارية. وبدأت الدراسة بتناول التكييف القانوني لجائحة كورونا باعتبارها قوة قاهرة، ثم تناولت تكييفها باعتبارها ظرف طارئ أو عمل من أعمال السلطة، وتضمنت في ثناياها الاجتهادات القضائية والآراء الفقهية المتصلة بمختلف الاتجاهات بغية الوصول إلى تكييفها الصحيح، وترتيب الآثار القانونية المنسجمة مع ذلك التكييف القانوني.
|b This study addresses a vital subject of administrative law at present, it is the subject of the legal adaptation of the impact of the coronavirus pandemic on the implementation of administrative contracts, the pandemic has imposed unprecedented effects on different walks of life, in particular, with regard to administrative contracts concluded by public utilities to ensure their continuity, this has sparked legal controversy with a view to achieving adequate legal adjustment of the impact of the coronavirus pandemic on the implementation of administrative contracts. The study began by addressing the legal adaptation of the coronavirus pandemic as a force majeure; it then dealt with their adaptation as an emergency circumstance or an act of authority, they included jurisprudence and jurisprudence relating to different trends in order to arrive at their proper adaptation and to arrange legal effects consistent with that legal adaptation.
