|a يعتبر مبدا الأمن القانوني من أهم مقومات دولة القانون، حيث أنه يسعى إلى تحقيق الاستقرار النسبي للقوانين والابتعاد عن السبل التي من شأنها أن تهدم الحقوق المكتسبة والمراكز القانونية المحققة للأفراد، من خلال التشريع الفجائي، ونظرا لأهمية هذا المبدأ سارعت الجزائر كما أغلب الدول نحو تكريسه وهو ما نص عليه صراحة الدستور الجزائري. تهدف هذه الدراسة نحو بلوغ فكرة الأمن القانوني انطلاقا من ضبط مدلول المبدأ وتحديد مميزاته مع شرح دور المحكمة الدستورية في حمايته وفق التعديل الدستوري لسنة 2020.
|b The principle of legal security is considered one of the most important foundations of the rule of law, as it seeks to achieve relative stability of laws and move away from ways that would destroy the acquired rights and legal status of individuals through sudden Due to the importance of this principle, Algeria, like most countries, hastened to enshrine it, which is explicitly stipulated by the Algerian constitution. This study aims to achieve the idea of legal security based on adjusting the meaning of the principle and determining its advantages while explaining the role of the Constitutional Court in protecting it in accordance with the 2020 constitutional amendment.
