|a لعل أهم مبدأ في القانون الجنائي هو مبدأ الجريمة والعقاب. فكانت المؤسسات السجنية إلى اليوم المكان الإصلاحي والباعث إلى الردع في نفوس العموم في إطار الحد أو التقليل من نسبة الجرائم لكن سرعان ما أصبح الهدف من العقوبة غير ملحوق بسبب اكتضاض هذه الأخيرة أو فقط لعدم نجاعتها. بالإضافة إلى ظهور ما يسمى بالجرائم الاقتصادية التي يكون فيها سلب الحرية غير ذي معنى وغير نافع. هذا ومراعاة لما تكلفه للدولة من مصاريف بناء وتجهيز. اضحى من اللازم العثور على حلول موازية تستطيع ربما تحقيق الغاية من العقاب باعتبار ضرورة تسهيل عملية الإدماج البعدي في المجتمع وأسرة المحكوم نفسها. ومن هنا نتجت فكرة العقوبات البديلة كركيزة لتطوير السياسية الجنائية.
|b The most important Principe in criminal law is that of crime and punishment. Until recently, penal institutions were seen as places of reform and deterrence, with the aim of reducing or preventing crime. However, the objective of punishment soon became detached, due to prison overcrowding or simply inefficiency. On top of this, with the emergence of economic crime, deprivation of liberty is losing its meaning and usefulness. This, coupled with the high costs incurred by the state in building and equipping prisons, makes it necessary to look for alternative solutions that might perhaps achieve the objective of punishment while facilitating the process of long-term social integration for the convicted person and his or her family. This gave rise to the idea of alternative sanctions as a pivotal point in the development of criminal policy.
