المستخلص: يعتبر موضوع الحقوق والحريات من أكثر المواضيع أهمية في القانون، وقد برزت أهميته أكثر بتطور الحياة في مختلف المجالات وعلى إثره نادت إعلانات دولية كثيرة ودساتير الدول بالحقوق والحريات العامة ودعت إلى كفالة حمايتها من خلال مبدأ المساواة، هذا المبدأ الذي يعتبر أصل الحقوق الأخرى. ولما كان القانون وليد المجتمع، يتطور وينمو بتطوره ونموه، فإن هذه الحقوق والحريات تتطور مجالاتها وتتغير أبعاد العلاقة بين أطرافها سواء تمثلت في الدولة أو الأفراد، لهذا فإن الحقوق والحريات لا يمكن لها أن تقوم إلا في ظل دولة قانونية تكفل هذه الحقوق وتحترمها وتحميها. وحيث أن حقوق الإنسان هي قيم قبل أن تكون قواعد قانونية، فقد أصبح من الضروري البحث في أساسها الفلسفي والفكري حتى نتشبع بثقافتها وأخلاقياتها الإنسانية التي ولا شك ستكون بمثابة الموجه الذي يُشعرنا بأهمية احترام الإنسان وضمان الحماية اللازمة لحقوقه.

The subject of rights and freedoms is one of the most important subjects in law, and its importance has become more evident with the development of life in various fields, and as a result, many international declarations and constitutions of countries have called for public rights and freedoms and called for ensuring their protection through the principle of equality, this principle which is considered the origin of other rights. Since the law is a product of society, it develops and grows with its development and growth, the scope of these rights and freedoms develops and the dimensions of the relationship between its parties change, whether represented by the state or individuals. Therefore, rights and freedoms can only exist under a legal state that guarantees, respects and protects these rights. Since human rights are values before they are legal rules, it has become necessary to research their philosophical and intellectual basis so that we can be saturated with their culture and human ethics, which will undoubtedly serve as a guide that makes us feel the importance of respecting the human being and ensuring the necessary protection of his rights.
