|a تهدف هذه الدراسة إلى تحديد وتوضيح الطابع التنظيمي لمجلس المنافسة الذي أوكل إليه ضبط المنافسة في السوق مع تضمين هذه الدراسة الاختصاصات التي يمارسها هذا الجهاز كآلية قانونية وعملية، وتحليل مدى موائمة صلاحياته أمام السلطات القطاعية والسلطة التنفيذية التي منحها القانون إلى جانب المجلس مجالا في ضبط السوق في مواجهة المتعاملين الاقتصاديين والمؤسسات كما تهدف إلى تحديد التداخل في الاختصاص والآثار المترتبة عليه، بينه كسلطة عامة وبين باقي السلطات القطاعية، كما تشير هذه الدراسة إلى ما يقتضيه الأمر لحل هذه الإشكالية وإرساء قواعد المنافسة وتطويرها بما يخدم الاقتصاد العام في الدولة، وضمان ممارسة المنافسة مع مراعاة احتياجات المستهلك وخدمته على نحو يتماشى مع المتغيرات الاقتصادية المتسارعة.
|b This study aims to identify and clarify the organisational nature of the Competition Council, which has been charged with monitoring competition in the market. This study includes the competences exercised by this body as a legal and practical mechanism and the extent to which its powers are aligned with the sectoral authorities and the executive authority, to which the law gives the possibility of controlling the market in relation to economic concessionaires and institutions. It also aims to identify the overlapping powers and implications between this public authority and others ectoral authorities, and this study indicates what is needed to resolve this issue and establish competition rules and develop them in the interests of the public economy in the country.
