المستخلص: The ambiguity and vagueness of the legal regulation framing the powers of the control authorities in Algeria generate several legal problems, as is the case for the broad jurisdiction of the Insurance Supervision Committee in the field of competition in the presence of a specialized council to control this area. If we explain this overlap in the competencies between the Committee and the Competition Council from the perspective of multiple disciplines in the field of competition, it will not be a way out to solve this problem unless it is accompanied by a review by the Algerian legislature of the mechanisms of cooperation and coordination between these two authorities, specifying for each of them the scope of its competence, using the experiences of comparative legislation in this field. Le flou entourant la réglementation juridique encadrant les attributions des autorités de régulation en Algérie suscite beaucoup de problématiques juridiques, comme c’est le cas de la commission de la supervision des assurances (CSA) qui dispose de larges compétences en matière de concurrence, et ce en dépit de l’existence d’une autorité spécialisée dans ce domaine: le Conseil de la concurrence. On peut expliquer ces conflits de compétences entre la CSA et le Conseil de la concurrence sous l’angle de l’inter régulation dans le domaine du droit de la concurrence. Mais on ne peut trouver des solutions à ces situations conflictuelles que si le législateur algérien mettrait en place des mécanismes de collaboration entre ces deux entités en délimitant leurs champs de compétences respectifs, et cela en s’appuyant sur les expériences des législations du droit comparé dans ce domaine.

إن غموض وإبهام التنظيم القانوني المؤطر لصلاحيات سلطات الضبط في الجزائر يولد عدة إشكالات قانونية، كما هو الحال للاختصاص الواسع للجنة الإشراف على التأمينات في مجال المنافسة في ظل وجود مجلس متخصص لضبط هذا المجال. فإذا فسرنا هذا التداخل في اللاختصاصات بين اللجنة ومجلس المنافسة من منظور تعدد الضبط في مجال المنافسة لا يكون مخرجا لحل هذا الإشكال، إلا إذا صاحبه مراجعة المشرع الجزائري لآليات التعاون والتنسيق بين هاتين السلطتين مع تحديد لكل منها نطاق اختصاصها، استعانة بتجارب التشريعات المقارنة في هذا المجال.
