|a يهدف البحث إلى جمع المسائل التي تقل فيها الإجماع في أبواب عقود الإطلاقات، وبيان من نقل الإجماع من أهل العلم، تنصيصا أو اتفاقا، والتحقق من ثبوت الخلاف في المسألة المبحوثة، ودراستها دراسة فقهية مقارنة، وتوضيح درجة الخلاف في المسألة قوة وضعفا، ولقد استخدم الباحث المنهج الاستقرائي؛ ومن أبرز النتائج التي توصل إليها الباحث: يُعد الإجماع المصدر الثالث من مصادر التشريع، فقد أجمع العلماء على حجيته، واشترطوا معرفته لبلوغ رتبة الاجتهاد، ولا يحل لمكلف أن يُخالف الإجماع بعد أن علمه. ومعرفة مسائل الإجماع في مجال عقود الإطلاقات يساعد على معرفة حقوق وواجبات الناس في تعاملاتهم الحياتية في البيوع والتوكيلات، وغيرها من الأبواب. وندرة نصوص الإجماع الواردة عن علماء الصدر الأول من هذه الأمة.
|b The research aims to: compile the issues in which consensus (ijma') has been reported within the chapters of general contracts, identify the scholars who have reported the consensus, either explicitly or implicitly, verify the presence of disagreement on the discussed issues, study these issues through a comparative fiqh (Islamic jurisprudence) analysis, and clarify the strength or weakness of the disagreements. The researcher employed the inductive method. Key findings of the research include:- Consensus (ijma') is considered the third source of Islamic legislation. Scholars have unanimously agreed on its authority and have stipulated its knowledge as a requirement for attaining the rank of ijtihad (independent legal reasoning). It is not permissible for anyone obligated to follow Islamic law to contradict a consensus after being aware of it.Identifying issues of consensus in the realm of general contracts helps in understanding the rights and obligations of individuals in their daily transactions, such as sales, agency contracts, and others. here is a scarcity of recorded instances of consensus from the early generations of this Ummah (Muslim community.
