المستخلص: يهدف البحث لدراسة تحليلية لمبدأ النص الصريح في تفسير المعاهدات الدولية من قبل محكمة العدل الدولية، حيث يقوم هذا المبدأ على أساس أن لتفسير أي نص في المعاهدة يجب أن يكون وفقا للغة الواضحة والصريحة المستخدمة فيه، دون اللجوء إلى تأويلات خارجية، أو استنتاجات غير مستمدة مباشرة من النص، هذا النهج يضمن فهما موحدا وواضحا للالتزامات والحقوق التي تنص عليها المعاهدات، مما يساعد في تجنب النزاعات، والتفسيرات المتضاربة التي قد تنشأ من الاعتماد على المعاني الضمنية، أو المعاني والمتعددة للكلمات. كما توصل البحث إلى العديد من النتائج كان أهمها أن تطبيق مبدأ النص الصريح يسهل عمليات التحقق والرقابة وفقا للمعاهدات الدولية، ويوفر أيضاء إطارا واضحا لمراقبة تنفيذ المعاهدة، ويسمح بتقييم دقيق للتقدم، ويعزز الالتزام بمبادئ الشفافية والمساءلة؛ مما يدعم الثقة والتعاون بين الدول الأطراف. كما أوصى البحث على ضرورة تعزيز التعاون الدولي في تطوير وصياغة المعاهدات لضمان تفسيرها وفقا لمبدأ النص الصريح، ويتضمن ذلك تبادل الخبرات، والممارسات الفضلى بين الدول في مجال تفسير الاتفاقيات الدولية، ويمكن أن يساهم ذلك في خلق بيئة قانونية دولية تتسم بالفعالية والشفافية، وتدعم الأمن والاستقرار العالميين.

The aim of this research is to conduct an analytical study of the principle of explicit text in the interpretation of international treaties by the International Court of Justice. This principle is based on the premise that the interpretation of any treaty text should be in accordance with the clear and explicit language used therein, without resorting to external interpretations or conclusions not directly derived from the text. This approach ensures a unified and clear understanding of the obligations and rights stipulated in the treaties, helping to avoid conflicts and contradictory interpretations that may arise from relying on implicit or variable meanings of words. The research arrived at several conclusions, the most important of which is that the application of the principle of explicit text also facilitates verification and monitoring processes within the framework of international treaties. This approach provides a clear framework for monitoring the implementation of treaty obligations, allowing for accurate assessment of progress and enhancing adherence to principles of transparency and accountability, thus supporting trust and cooperation among state parties. The research also recommended the necessity of enhancing international cooperation in the development and drafting of treaties to ensure their interpretation according to the principle of explicit text. This includes exchanging expertise and best practices among countries in the field of interpreting international agreements. Such efforts can contribute to creating an effective and transparent international legal environment, supporting global security and stability.
