المستخلص: الهدف من البحث: يهدف البحث إلى مناقشة الذمة المالية للزوجة في الفقه الإسلامي وفي الشرائع الأخرى؛ للوقوف من خلاله على مكانة المرأة في الإسلام وما كفله الإسلام للمرأة من حقوق تتعلق بذمتها المالية، وإظهار الحكم الشرعي لاستقلال الذمة المالية للزوجة في الإسلام وفقا لما ورد في أقوال الفقهاء، وذلك بعد مقارنة وضع المرأة في الشرائع الأخرى بمكانتها في الإسلام؛ منهج البحث: يتبع هذا البحث المنهج الوصفي الاستقرائي والتحليلي، من خلال عرض آراء الفقهاء والمذاهب بشكل واضح متتبعا لها ومتحققا منها، بعيدا عن التحيز لرأي مذهب من المذاهب، وذلك من خلال عرض أدلة الفقهاء ومناقشتها وبيان الراجح منها مع التعليل معتمدا بذلك المنهج التحليلي، ومن ثم الربط بين الراجح من هذه المسائل والواقع الذي نحياه من ناحية، وعرض ما ورد في الشرائع السماوية الأخرى في هذا الصدد من ناحية أخرى. أهم النتائج: 1. سبق الشريعة الإسلامية لكافة الشرائع والتشريعات الوضعية البشرية في تقرير حقوق المرأة المالية والاعتراف باستقلال ذمتها المالية. ۲. رقي الإسلام وعدله في نظرته للمرأة حيث أعطاها حقوقها المالية وغير المالية كاملة غير منقوصة، وحررها من كل القيود التي تسلبها حقوقها وأهليتها في التصرف والتملك، وساواها بأخيها الرجل في الحقوق والواجبات فهي منه وهو منها 3. إن الشبه التي يثيرها أعداء الإسلام من العلمانيين وأتباعهم ممن أمن بثقافتهم وأفكارهم والتي تتهم الإسلام بالممايزة والتفريق بين الرجل والمرأة في الحقوق والواجبات والكرامة والمكانة... استنادا إلى بعض الجوانب التي فرق الإسلام فيها بين الرجل والمرأة، ما هي إلا شبه باطلة واهية أوهن من بيت العنكبوت، ليس لها دليل ولا مستند سوى فبركة الكلام والتصنع فيه. ٤. إن الممايزة بين الذكر والأنثى في بعض الحقوق والجوانب، لا يعني هضم حقوق المرأة وظلمها.

The aim of the research: The research aims to Discussing the “financial responsibility of the wife in Islamic jurisprudence and other laws”; To find out through him the status of women in Islam And the What Islam guaranteed to women in terms of rights Attached to its financial liability, Demonstrating the Sharia ruling on the independence of the wife's financial responsibility in Islam according to what was stated in the sayings of the jurists, after comparing the position of women in .other laws to their position in Islam Research Methodology: This research follows the descriptive, inductive and analytical approach, by presenting the opinions of jurists and doctrines in a clear manner, following and verifying them, away from the bias of the opinion of one of the schools of thought, by presenting the evidence of the jurists, discussing them, and stating the most correct of them with the reasoning relying on that analytical approach, and then linking between The most correct view of these issues and the reality that we live on the one hand, and the presentation of what has been .mentioned in other divine laws in this regard on the other hand Main results: 1. The Islamic Sharia preceded all the laws and legislations of the human condition in determining the financial rights of women and the recognition of the independence of their financial .responsibilities. 2. Islam promoted and justified women in its view of women, as it gave her full and uncompromised financial and non-financial rights, and freed her from all restrictions that rob her of her rights and capacity to dispose of and own property, and equal her with .her brother the man in rights and duties 3. The resemblance raised by the enemies of Islam from among the secularists and their followers who believed in their culture and ideas and which accuse Islam of differentiating and differentiating ... between men and women in rights, duties, dignity and status based on some aspects in which Islam differentiated between men and women, it is nothing but a void, weak and weaker than a home.
