المستخلص: في ظل ظروف انتشار وباء كورونا، ونظرا لانتشار عقود الإجارة بنوعيها، وما قد يترتب على التدابير الوقائية المتخذة بسبب انتشار الوباء من حصول النزاع بين أطراف عقد الإجارة بسبب تعذر استيفاء المنافع، فقد جاء هذا البحث الإيضاح الحكم الشرعي لتلك العقود ومدى لزومها، الإجارة وبيان كمال الشريعة بإظهار حكمها في مثل هذه الظروف الاستثنائية، وقد فرق البحث بين ما إذا كان عقد قد تأثر بسبب التدابير الوقائية- تأثرا كبيرا، أو يسيرا، أم لم يتأثر أصلا بذلك، وذكر حكم العقد ما إذا كانت مدة العقد قد انتهت أو بقي فيها بقية، وإذا تعذر إسقاط جزء من الأجرة مقابل ما فات من المنفعة أو لم يتعذر، وضابط المنفعة التي يتعذر استيفاؤها، والحكم في ذلك وأثر هذه التدابير الوقائية فيما يتعلق بأجرة الأجير سواء كان خاصا أو عاما، كما تعرض البحث لأثر التدابير الوقائية في عقد الإجارة بسبب انتشار وباء كورونا.

In light of the circumstances of the spread of Corona epidemic, and due to the spread of leasing contracts of both types, and the preventive measures taken as a result of the spread of the epidemic which led to the conflict between the parties of the lease contract owing to the inability to meet the benefits, the research comes to clarify the legal rule of those contracts and the extent of their necessity. It shows the perfection of Sharia by showing the legal rule of leasing in such exceptional circumstances. The research differentiated between whether a contract was significantly affected, little affected or not affected at all by the preventive measures. It also mentioned the rule of the contract, whether its period has terminated or there is a remainder therein, and if part of the wage cannot be dropped in exchange for the loss of the benefit or not, and the control of the benefit that cannot be met, the rule on that and the effect of these preventive measures in relation to the wage of the employee, whether it is special or general.
