المستخلص: يهدف البحث إلى إبراز حقيقة الأمر، ومدلوله، وبيان صيغه، ومعانيه الدالة عليه، وكذلك بيان موقف الأصوليين من دلالة الأمر الوارد بعد الاستفهام، وبيان ثمرة الخلاف منه، وأثر ذلك في الفروع الفقهية من خلال التأصيل الشرعي له، وجاء البحث تحت عنوان: "دلالة الأمر الوارد بعد الاستفهام دراسة أصولية تطبيقية"، واشتمل البحث على: مقدمة، وتمهيد، وثلاثة مباحث، وخاتمة، غايته: ربط الأصول بالفروع الفقهية؛ لأن ضبط قضايا الأمر ودلالاته له أهمية بالغة في فهم مقاصد الشرع، ومن ثم يوثر ذلك على عملية استنباط الأحكام الشرعية، وأكد البحث على أن الأمر الوارد بعد الاستفهام؛ الحكم فيه على الراجح يختلف باختلاف مقتضى السؤال من إباحة، أو إجزاء، أو وجوب، وبين أن السؤال إن كان مقتضاه عن الإباحة، فالأمر في جوابه يقتضي الإباحة، وإن كان السؤال مقتضاه عن الإجزاء؛ فالأمر في جوابه يقتضي الإجزاء، وإن كان السؤال مقتضاه عن الوجوب؛ فالأمر في جوابه يقتضي الوجوب، ونبه على أن الأمر الوارد بصورة الاستفهام؛ يعطى الكلام حيوية، ويزيد من الإقناع والتأثير، وفيه إثارة للسامع، وجذبا لانتباهه، وإشراكا له في التفكير؛ ليصل بنفسه إلى الجواب دون أن يملى عليه، وحث على ضرورة الاهتمام بالدراسة التطبيقية للقواعد والأحكام الأصولية، بما يسهل فهم القواعد والأحكام الأصولية، ويعين على إدراكها، وهو ما يعرف بتخريج الفروع على الأصول.

The research aims to highlight the truth of the command, its meaning, and explain its formulas and meanings that indicate it, as well as to explain the opinion of the fundamentalists about that, and the result of disagreement from it. It explains also its impact on the branches of jurisprudence through its legal rooting. The research came under the title: “The meaning command mentioned after the question is a study“ Applied Fundamentalism.” The research included: an introduction, a preface, three sections, and a conclusion. Its goal is to link the principles to the branches of jurisprudence, because controlling the issues of the command and its implications is of great importance in influencing the understanding of the objectives of Sharia law, therefore affects the process of deducing Sharia rulings. The research confirmed that the judgement on the command mentioned after the question varies depending on the requirement of the question, whether permissibility, permissibility, or obligation. It assured that if the question’s requirement is about permissibility, then the command in the answer requires permissibility. And if the question’s requirement is about compensation, the command in the answer requires compensation. And if the question requires it about obligation; the command in the answer necessitates obligation. It pointed out that the command stated in the form of an interrogative, gives speech vitality, increases persuasion and influence, stimulates the listener, attracts his attention, and engages him in thinking, to arrive at the answer himself without being dictated. The research urged the need to pay attention to the applied study of the fundamental rules and rulings, in a way that facilitates the understanding of the fundamental rules and rulings, and helps to realize them, which is known as explanation branches onto the fundamentals.
