| 520 | |b This research aims to shed light on a newly emerged type of marriage known as "Misyar marriage," which originated in the Gulf countries. With the acceleration of societal and economic changes, it has quietly made its way into Algeria over the past decade. Scholars have been divided on this form of marriage, with one group supporting it as a means of preserving chastity for men and providing a means of marriage for unmarried women (spinsters), while the opposing group views it as a threat to the family and society. The research has concluded that this type of marriage contradicts the noble aims of marriage and the objectives of Islamic law. The research also delves into Algerian family law and finds that it aligns with the Islamic jurisprudential perspective. Consequently, there is a legal and religious responsibility to curb the spread of this type of marriage as a preventive measure and to address the negative impacts it has had on the depth and structure of society. | ||
