المستخلص: إن شريعة نبينا هي خاتمة الشرائع وهي الخالدة حيث استكملت تلبية احتياجات البشر من التنظيم الإلهي الحكيم القائم على الأسس والقواعد التي تحكم الواقع في الحالات الأصلية والابتدائية والطارئة. وبما أن التطور العلمي يتطلب المواكبة والاستعداد لتطورات الحياة، فإن هذه الدراسة الموسومة بـ (تكييف المستجدات في ضوء مقاصد الشريعة) ستكون دراسة في أصول وقواعد الأصول الفقهية التي تحكم المستجدات والنوازل بما يتفق مع علاقتها بعلم الفقه القائم على أسس ثابتة وثابتة وفروع مرنة قادرة على ضبط التصرفات. وتؤكد على ضرورة الاهتمام بآليات فهم النصوص والتعرف على أدوات ذلك الفهم مع التركيز على معرفة دلالات النصوص وتحديد محتواها ومعناها وأنواعها وقوتها وترتيبها. واعتمدت الدراسة على أسباب منطقية لاختيار مثل هذه الموضوعات، ودعت إلى التمييز بين استيعاب المتغيرات والتخصص العلمي الدقيق وفق منهج شامل لجميع القضايا والمسائل والتعاريف والأسس والقواعد بنظرات تجديدية لا تحدث إشكالات بل إنها تمثل إضافات مقيدة بالحذر الذي يصقل القديم وتحافظ على مصالح الناس في الدنيا والآخرة. وهكذا، وبالتالي تحقق المقصد الشرعي العام المتمثل في الحفاظ على الأمن المجتمعي من خلال مراعاة المصالح الخاصة لأفراد المجتمع بطريقة لا تتعارض مع المصالح العامة للمجتمع. أما الفكرة التي تنطلق منها هذه الورقة فهي الإجابة على أسئلة الدراسة المتمثلة في: ما هي الجهود التي بذلها العلماء السابقون لضبط النظر في قضايا المستجدة في الحياة واستنباط الأحكام الشرعية بشأنها؟ ما أثر ذلك في توجيه الباحثين لمواجهة المستجد والمعاصر؟ وأسئلة فرعية أخرى. وخرجت بعدد من النتائج أهمها: أن الأسلوب العلمي الرصين لا يستنكره أصحاب العقول السليمة عند التكييف الشرعي للمستجدات ما دامت تتفق مع مقاصد الشريعة وبذلك يحقق مكاسب مجتمعية ومصالح مشروعة تأخذ في الحسبان الأهداف العامة ثم التوصيات أهمها: إجراء البحوث ونشرها بشكل مستمر من أجل المساعدة في الفهم الصحيح للخطاب الشرعي. استصحاب القرائن والإصلاحات والسياقات للاستعانة بها واستخدامها لاستنباط الأحكام الفقهية الشرعية لمعالجة فقه الواقع وفقه التوقع (فقه الارتياد). وفق منهج موضوعي واستقرائي، يتم من خلاله تنظير الجزيئات وربطها بالكليات، وكل هذا يخضع للتحليل، في محورين المحور الأول -حول مفاهيم الدراسة وأدواتها لفهم النصوص في مبحثين؛ المحور الثاني -دراسة تفصيلية لنماذج التطورات المعاصرة وبيان مراعاة مقاصد الشريعة في مبحثين.

Where the needs of human beings were fulfilled from the wise divine organization based on the foundations of rules governing reality in the original, elementary and emergency situations. Since scientific development requires processions and preparation for life’s developments, this study, which is tagged with (adapting developments in light of the purposes of Sharia), is to be a study in the principles and rules of jurisprudential principles that control developments so that they are consistent with their relationship with the science of jurisprudence, which is based on firm, fixed foundations and flexible branches capable of controlling actions The servants with the provisions of the Sharia by understanding the meaning of the wise legislator, and his intent from the Sharia and emphasizing the need to pay attention to the mechanisms of understanding the texts and to identify the tools of that understanding with a focus on knowing the semantics of the texts and identifying their content and meaning and addressing their types and their strength and arrangement. The study relied on logical reasons for choosing such topics, calling for a distinction between the assimilation of variables and precise scientific specialization according to a comprehensive approach to all issues, issues, definitions, foundations and rules with innovative looks that do not cause problems; Rather, they represent additions bound by caution that refines the old and preserves the interests of people in this world and the hereafter. Thus, the general legitimate objective of maintaining societal security was achieved by taking into account the private interests of its members in a way that does not intersect with the overall interests of society. As for the idea that this paper stems from, it is the answer to the study’s questions represented in: What are the efforts made by previous scholars to control the consideration of life issues and elicit legal rulings for them? What is the impact of this in directing researchers to confront new and contemporary ones? And other sub-questions. It came out with the most important results, the most important of which are: the sober scientific method is not denounced by the owners of sound minds when adapting the Shariah to new developments as long as it is in accordance with the purposes of Sharia; It thus achieves societal gains and legitimate interests that take into account the overall purposes. Then recommendations, the most important of which are: conducting research and publishing it on a continuous basis in order to help in a proper understanding of the legal discourse; Refining presumptions, conventions, and contexts, and using them to elicit legal jurisprudential rulings to address the jurisprudence of reality and the jurisprudence of expectation (the jurisprudence of ertiyad). According to an objective and inductive approach, during which molecules are theorized and attached to faculties, and all of this is subjected to analysis, in two axes: the first axis- about study concepts and tools for understanding texts in two sections; The second axis- a detailed study of models of contemporary developments and a statement of observance of the purposes of Sharia in two sections.
