المستخلص: قرر العلماء قديما وحديثا: أن التكاليف كلها راجعة إلى مصالح العباد في دنياهم وأخراهم، وأن الشريعة جاءت بتحصيل المصالح وتكميلها، وتعطيل المفاسد وتقليلها، وأنها ترجيح خير الخيرين وشر الشرين، وتحصيل أعظم المصلحتين بتفويت أدناهما، ودفع أعظم المفسدتين باحتمال أدناهما، وأن أوامر الشرع تتبع المصالح الخالصة أو الراجحة، ونواهيه تتبع المفاسد الخالصة أو الراجحة. لهذا فإن الوعي والاهتمام بأهمية تكييف المستجدات وفق مقاصد الشريعة الغراء، وبأهمية تحقيق المصالح وارتباطها ارتباطا مطردا بالتشريع في الإسلام، اهتمام يرسم منهج حياة متكامل ومتجدد قائم على ما يحقق مصالح المكلفين، ويضمن لهم حياة كريمة. كما أن التنوع والاختلاف بين البشر في الفهم والتطبيق والقوة والضعف، ضمنه الشرع لتحقيق مصالح ضرورية، وأكد عليها ضمانا لتحقيق التوازن في المجتمع، والحد من التناحر والتطاحن، وما يترتب عليه من عدم استقرار المجتمعات وانتشار الفوضى أو الصراعات. ولأهمية هذا الموضوع فسوف نتناول جانبا مهما من جوانب تكييف المستجدات، وهو ما يتعلق بتكييف المستجدات المعاصرة وفق المقاصد الشرعية، من خلال مقدمة، ومبحثين، وأربعة مطالب، على النحو الآتي: * مقدمة، تحوي أهمية الموضوع وأبرز أهدافه، وعناصره. * التعريف بأهم المصطلحات. * المبحث الأول: تكييف المستجدات بين التقليد والمعاصرة، وفيه مطلبان: √ المطلب الأول: نظرة عامة على أبرز مناهج التكييف للمستجدات المعاصرة. √ المطلب الثاني: أهمية علم المقاصد في فهم المستجدات المعاصرة. * المبحث الثاني: النظرة المقاصدية للمستجدات وتطبيقاتها المعاصرة، وفيه مطلبان: √ المطلب الأول: المنهج المقاصدي في تكييف المستجدات ونماذج من تطبيقاته المعاصرة. √ المطلب الثاني: أثر تكييف المستجدات وفق مقاصد الشرع على أمن واستقرار المجتمع. الخاتمة، وبها أهم النتائج وأبرز التوصيات.

Scholars, ancient and modern, have decided that all costs are due to the interests of the people in this world and in the hereafter, and that the Shariah came to collect and complement the interests, and to disable and reduce the evil, and that it outweighs the good of the two good and the evil of the evil, and the achievement of the two greatest interests by missing the lesser of them, and the repulsion of the greatest evildoers by the possibility of the lesser of them, and that the commands of the Law are followed Pure or preponderant interests, and its prohibitions follow pure or preponderant evils. For this reason, awareness and interest in the importance of adapting developments according to the goals of Sharia, and the importance of achieving interests and their constant linkage with legislation in Islam, is an interest that draws an integrated and renewed life approach based on what achieves the interests of the taxpayers, and guarantees them a dignified life. Because of the importance of this topic, we will address an important aspect of adapting developments, which is related to adapting contemporary developments according to the legitimate purposes, through an introduction, two sections, and four demands, as follows: * Introduction, containing the importance of the topic, its main objectives, and its elements. Definition of the most important terms. * The first topic: adapting developments between tradition and contemporary, and it has two demands: * The first requirement: an overview of the most prominent methods of adaptation for contemporary developments. * The second requirement: the importance of the science of purposes in understanding contemporary developments. * The second topic: the intentional view of developments and their contemporary applications, and it has two demands: * The first requirement: the intentional approach in adapting developments and models of its contemporary applications. * The second requirement: the impact of adapting developments according to the purposes of Sharia on the security and stability of society. * The conclusion, which includes the most important results and the most prominent recommendations.
