المستخلص: فإن من نعم الله على المسلمين أن شريعة نبينا هي الخاتمة للشرائع وهى الخالدة حيث استكملت حاجات البشر من التنظيم الإلهي الحكيم، لذا لابد من تأسيس الأحكام والقواعد الحاكمة للواقع في الأحوال الأصلية، الابتدائية والطارئة. والتطور العلمي يقتضي المواكبة والاستعداد لمستجدات الحياة، وانطلاقا من مبدأ صلاحية التشريع الإسلامي لكل زمان ومكان واعتبارا لاستيفاء مصدريه (القرآن والسنة) حاجات العباد واحتياجاتهم التشريعية في عموم أحوالهم وخاصتها؛ تأتي هذه الدراسة الموسومة ب (تكييف المستجدات في ضوء مقاصد الشريعة) لتكن دراسة في مبادئ وقواعد أصولية فقهية تضبط المستجدات والنوازل بحيث تتسق مع علاقتها بعلم أصول الفقه، القائم على مرتكزات راسخة ثابتة وفروع مرنة قادرة على ضبط أفعال العباد بأحكام الشرع من خلال فهم مراد الشارع الحكيم، وقصده من انزال الشريعة والتأكيد على ضرورة الاهتمام بآليات فهم النصوص والتعرف على أدوات ذلك الفهم مع التركيز على معرفة دلالات النصوص -المتون والتعرف على فحواها، ومؤداها والتطرق لأنواعها ومدى قوتها وترتيب ذلك. وقد اعتمدت الدراسة على أسباب منطقية لاختيار مثل هذه المواضيع داعية للتمييز بين استيعاب المتغيرات والنوازل، والتخصص العلمي الدقيق وفق منهج شامل المجمل القضايا والمسائل والتعريفات والأسس والقواعد بنظرات تجديدية لا تحدث إشكالات؛ وإنما تمثل إضافات مقيدة بالحذر الذي يصقل القديم ويحافظ على مصالح العباد في الدنيا والآخرة. وبالتالي تحقق المقصد الشرعي العام المتمثل في المحافظة على الأمن المجتمعي من خلال مراعاة مصالح أفراده الخاصة بما لا يتقاطع مع مصالح المجتمع الكلية. حتى يمكننا الإجابة على تساؤلات الدراسة المتمثلة في: ما هي الجهود التي بذلها العلماء السابقين لضبط النظر في القضايا الحياتية واستنباط الأحكام الشرعية لها؟ وما مدى أثر ذلك في توجيه الباحثين لمواجهة المستجد والمعاصر منها؟ وغيرها من الأسئلة الفرعية. وقد خرجت بنتائج أهمها: الأسلوب العلمي الرصين لا ينكره أصحاب العقول السليمة عند التكييف الشرعي للمستجدات طالما جاء موافقا لمقاصد الشريعة؛ وهو بالتالي يحقق مكاسب مجتمعية ومصالح شرعية تراعي المقاصد الكلية. ثم توصيات أهمها: إجراء البحوث ونشرها بصورة متواصلة حتى تساعد على الفهم السليم للخطاب الشرعي، واستصحاب القرائن والاصطلاحات والسياق للاستعانة بها على استنباط الأحكام الشرعية الاجتهادية لمعالجة فقه الواقع (فقه النوازل). وفقه التوقع (فقه الارتياد). المنهج المتبع في ذلك منهج موضوعي ومنهج استقرائي يتم خلاله التنظير للجزيئات وإلحاقها بالكليات والمسلمات البديهية وإخضاع كل ذلك للمنهج التحليلي بهدف التحليل المنطقي لمعلومات صحيحة بغرض الحصول على نتائج سليمة. يستوعب الدراسة خطة في محورين: المحور الأول: حول مفاهيم الدراسة وأدوات فهم النصوص في مبحثين. المحور الثاني: دراسة تفصليه لنماذج مستجدات معاصرة وبيان مراعاة مقاصد الشريعة لها في مبحثين.

Our master- Muhammad, may God’s prayers and peace be upon him- and after, one of the blessings of God upon Muslims is that the law of our Prophet is the final of the laws and it is eternal, as the needs of human beings have been fulfilled from the wise divine organization. Scientific development requires keeping pace with and preparing for the developments of life, and based on the principle of the validity of Islamic legislation for every time and place, and considering that its two sources (the Qur’an and Sunnah) meet the needs of people and their legislative needs in general and specific conditions; This study, tagged with (adapting developments in the light of the purposes of Sharia) comes to be a study in the principles and rules of jurisprudential principles that control developments and calamities so that they are consistent with their relationship to the science of jurisprudence, which is based on firm, fixed foundations and flexible branches capable of controlling the actions of people with the provisions of Sharia through understanding the Murad of the street. Al-Hakim, and his intent to reveal the Shariah and to emphasize the necessity of paying attention to the mechanisms of understanding texts and identifying the tools of that understanding with a focus on knowing the semantics of the texts- the texts- and identifying their content, their meaning and addressing their types, strength and arrangement.

The study relied on logical reasons for choosing such topics, calling for a distinction between the assimilation of variables and crises, and accurate scientific specialization according to a comprehensive approach to all issues, issues, definitions, foundations and rules with innovative looks that do not cause problems; Rather, they represent additions restricted by caution that refines the old and preserves the interests of the people in this world and the hereafter. Thus, the general legitimate objective of maintaining social security is achieved by taking into account the interests of its members in a way that does not intersect with the overall interests of society. So that we can answer the questions of the study represented in: What are the efforts made by the previous scholars to control the consideration of life issues and elicit legal rulings for them? What is the impact of this in directing researchers to confront new and contemporary ones? And other sub-questions. I came out with the most important results: the sober scientific method is not denied by the owners of sound minds when the legal adaptation of developments as long as it is in accordance with the purposes of Sharia; It thus achieves societal gains and legitimate interests that take into account the overall purposes. Then recommendations, the most important of which are: conducting research and publishing it continuously in order to help a proper understanding of the legal discourse, and to accompany the clues, conventions and context to use them to derive legal jurisprudence rulings to address the jurisprudence of reality (the jurisprudence of calamities). The approach followed is an objective approach and an inductive approach, during which molecules are theorized and attached to faculties and axioms, and all of this is subjected to the analytical approach with the aim of logical analysis of correct information in order to obtain sound results. The study includes a plan in two axes: The first axis: about the concepts of the study and the tools for understanding texts in two sections. The second axis: a detailed study of contemporary models and a statement of the purposes of Sharia in two sections.
