|a تستند المرجعية الفقهية، لمدونة الأسرة المغربية، إلى ثوابت دينية، غير قابلة للتصرف فيها؛ ومتغيرات قابلة للتجديد والاجتهاد، لتكييفها مع تقلبات الزمن والمكان والأشخاص، ويسعى هذا البحث ليوضح حدود الثابت والمتغير في هذه المرجعية؛ حيث حصر الثابت في أمرين: الأول: الوحي الذي نقل إلينا بطرق مستفيضة جيلا بعد جيل، من لدن الصحابة إلى اليوم. والثاني: بعض المسائل التي أجمع فيها العلماء على رأي واحد، وخلص البحث إلى أن مجالات اليقين التي لا يطالها الاجتهاد محدودة، وتمثل السياج العام للشريعة؛ بينما يظل المجال القابل للاختلاف كثيرا، يسع الاجتهادات المتجددة عبر الزمن والمكان.
|b Moroccan family law is based on inalienable religious constants. and variables that can be renewed and diligent, to adapt them to the fluctuations of time, space and people. This research seeks to clarify the boundaries of the constant and variable in this reference. The constant is limited to two things: first: the revelation that has been conveyed to us in broad ways, generation after generation, from companions to today. II: Some issues on which scientists are unanimous. The research concluded that the areas of certainty that cannot be renewed are limited, and represent the general framework of Sharia law.. While the field remains vulnerable to many differences, it absorbs renewed efforts across time and space.
