المستخلص: يتناول هذا البحث دراسة متعمقة لمفهوم الحماية الدبلوماسية في إطار القانون الدولي العام، باعتبارها وسيلة قانونية للدولة لحماية حقوق ومصالح مواطنيها في الخارج، حيث تعد الحماية الدبلوماسية من أبرز الآليات التي تستخدمها الدول في العلاقات الدولية لضمان احترام حقوق رعاياها، سواء كان من خلال المساعي السلمية أو اللجوء إلى القضاء الدولي. يعتمد البحث على المنهج الوصفي والتحليلي لفهم طبيعة الحماية الدبلوماسية من جوانبها القانونية والتاريخية، مع تسليط الضوء على التطورات التشريعية التي شكلت هذا المفهوم. يركز البحث على تحليل شروط ممارسة الحماية الدبلوماسية، مثل ضرورة ارتباط الشخص المتضرر بجنسية الدولة الممارسة للحماية واستنفاذ كافة وسائل التقاضي المحلية في الدولة المضيفة. كما يستعرض البحث الوسائل السياسية والقضائية المتاحة للدول الممارسة هذه الحماية، مثل المفاوضات والمساعي الحميدة، إضافة إلى المحاكم الدولية مثل محكمة العدل الدولية. ومن خلال استعراض الفقه القانوني وأحكام محكمة العدل الدولية، يوضح البحث الفرق بين الحماية الدبلوماسية والحصانة الدبلوماسية، ويبين أن الحماية الدبلوماسية تمارس لصالح الأفراد في حين أن الحصانة ترتبط بالدبلوماسيين والبعثات الدبلوماسية. كما يناقش البحث المسؤولية الدولية الناجمة عن خرق حقوق الأجانب والتطبيقات العملية لهذه المسؤولية. يخلص البحث إلى أن الحماية الدبلوماسية تمثل حقا سياديا للدولة يمارس بناء على مصالحها الوطنية، وليس حقا فرديا للشخص المتضرر. كما يتناول البحث التحديات التي تواجه الحماية الدبلوماسية في ظل النظام الدولي المعاصر، ويقدم توصيات بضرورة وضع معايير دولية موحدة تعزز من كفاءة هذه الحماية وتضمن حقوق الأفراد في الخارج.

His research provides an in-depth study of the concept of diplomatic protection within the framework of public international law, considering it a legal means for the state to protect the rights and interests of its citizens abroad. Diplomatic protection is regarded as one of the most prominent mechanisms used by states in international relations to ensure the protection of their nationals' rights, either through peaceful means or by resorting to international courts. The research adopts a descriptive and analytical approach to understand the nature of diplomatic protection from its legal and historical aspects, while shedding light on the legislative developments that have shaped this concept. The research focuses on analyzing the conditions for exercising diplomatic protection, such as the necessity of the harmed person holding the nationality of the state providing protection and exhausting all local legal remedies in the host state. It also reviews the political and judicial means available to states to practice this protection, such as negotiations and good offices, in addition to international courts like the International Court of Justice. Through examining legal doctrine and the rulings of the International Court of Justice, the research clarifies the distinction between diplomatic protection and diplomatic immunity, noting that diplomatic protection is exercised on behalf of individuals, while immunity applies to diplomats and diplomatic missions. The research further discusses the international responsibility arising from violations of the rights of foreigners and the practical applications of this responsibility. The research concludes that diplomatic protection represents a sovereign right of the state, exercised based on its national interests, rather than an individual right of the affected person. It also addresses the challenges facing diplomatic protection in the contemporary international system and provides recommendations for establishing unified international standards that enhance the efficiency of this protection and ensure the rights of individuals abroad.
