المستخلص: تعتبر السيادة مفهوما أساسيا في القانون الدولي، وقد شكلت حجر الزاوية في النظام الدولي التقليدي، ومع ذلك، فإن التغيرات الجذرية التي يشهدها العالم، قد أحدثت تحولات جوهرية في مفهوم السيادة وتطبيقاته، هذا البحث يسعى إلى تحليل التأثير المتبادل بين قواعد القانون الدولي العام ومفهوم السيادة، وتحديد التحديات التي تواجه هذا المفهوم في ظل التطورات المعاصرة، سيتم ذلك من خلال تحليل تطور مفهوم السيادة تاريخيا، ودراسة الآثار العملية لقواعد القانون الدولي العام على ممارسة الدول لسيادتها، وتقييم مدى ملاءمة الإطار القانوني الدولي الحالي لمواجهة التحديات المعاصرة. يتناول هذا البحث إشكالية التناقض الظاهري بين مبدأ السيادة، وبين التزايد المستمر في التزامات الدول بموجب المعاهدات الدولية، فبينما تؤكد السيادة على حق الدولة في اتخاذ قراراتها بشكل مستقل، فإن المعاهدات الدولية تفرض قيودا على هذه السلطة؛ هذا التناقض يطرح تساؤلات حول مدى تأثير قواعد القانون الدولي العام، على مفهوم السيادة في ظل التحولات العالمية المتسارعة. وتبرز أهمية هذه الدراسة وأصالتها في التعرف على مفهوم السيادة الدولية، كونها تعتبر من المبادئ الأساسية التي يقوم عليها القانون الدولي العام والعلاقات الدولية المعاصرة، حيث تواجه العديد من التحديات، ومعرفة التطورات الاجتماعية التي انعكست على تطور مفهومها، والتطور التاريخي لها. اعتمدت هذه الرسالة على المنهج الاستنباطي التحليلي؛ وذلك بتحليل القواعد القانونية ذات الصلة، وتقييم تأثيرها على مفهوم السيادة، مع التركيز على الحالات التي تظهر فيها تقييدات على السيادة الوطنية نتيجة للمعاهدات الدولية. وقد خلص هذا البحث إلى عدة نتائج أهمها؛ أن مبدأ السيادة يمثل الضمانة القانونية لاستقلال الدول وسلامتها، فهو يمنح كل دولة الحق في حماية أراضيها ومواردها، واتخاذ القرارات التي تراها مناسبة لشعبها، دون تدخل من أي قوة خارجية، وذلك في إطار احترام مبادئ القانون الدولي، ومن هنا جاءت فكرة الكتابة في هذا البحث الذي يتناول هذه الجوانب وما يتصل بها، ليكون موسوما بـ: "تأثير قواعد القانون الدولي العام على مفهوم السيادة الوطنية في ضوء المعاهدات الدولية".

Sovereignty is a fundamental concept in international law and has been the cornerstone of the traditional international system. However, the radical changes that the world is witnessing have brought about fundamental shifts in the concept of sovereignty and its applications. This research seeks to analyze the mutual influence between the rules of public international law and the concept of sovereignty, and to identify the challenges facing this concept in the context of contemporary developments. This will be done by analyzing the historical development of the concept of sovereignty, studying the practical implications of the rules of public international law on the exercise of state sovereignty, and assessing the adequacy of the current international legal framework to address contemporary challenges. This research addresses the apparent contradiction between the principle of sovereignty and the increasing number of states' international treaty obligations. While sovereignty emphasizes a state's right to make its own decisions independently, international treaties impose limitations on this authority. This contradiction raises questions about the extent to which the rules of public international law have affected the concept of sovereignty in the face of rapid global changes. The significance and originality of this study lie in its exploration of the concept of international sovereignty. As one of the fundamental principles underpinning international law and contemporary international relations, sovereignty faces numerous challenges. This study aims to understand the social developments that have shaped the evolution of this concept and its historical trajectory. This research adopted a deductive-analytical approach. It involved analyzing relevant legal rules and assessing their impact on the concept of sovereignty, with a particular focus on instances where international treaties impose limitations on national sovereignty. This research concluded that the principle of sovereignty is the legal guarantee of the independence and integrity of states. It grants each state the right to protect its territory and resources, and to make decisions it deems appropriate for its people, without interference from any external force, while respecting the principles of international law. Hence, this research was undertaken to delve into these aspects and their related issues. It is thus entitled: "The Impact of Public International Law on the Concept of National Sovereignty in Light of International Treaties."
