المستخلص: يهدف هذا البحث إلى دراسة مكانة رئيس الجمهورية في دستور 20 يوليو 1991 ودراسة الاختصاصات التي يتمتع بها، والتي تكشف مستوى السلطة التي يتمتع بها داخل النظام وعلاقته بالسلطات الأخرى ومستوى تأثيره عليها وتفاعله معها. وقد توصل البحث إلى أن المكانة الدستورية لرئيس الجمهورية، تبقى هي الإهم على مستوى النظام السياسي فرئيس الجمهورية وانطلاقا من انتخابه المباشر، يحظى بشرعية انتخابية لا نظير لها من حيث الشمولية والتركيز وهو ما جعل المؤسس الدستوري يلقي على كاهله مسؤولية تجسيد الدولة وحماية الدستور، وضمان السير المنتظم للسلطات العمومية، وزيادة على هذه الاختصاصات يهيمن رئيس الجمهورية على السلطة التنفيذية ويمارسها، أما السلطة التشريعية والقضائية، فلرئيس الجمهورية صلاحيات تطال كلا من هتين السلطتين بطريقة تضمن له التفوق عليهما.

This research aims to study the position of the President of the Republic in the Constitution of July 20, 1991 and to study the powers he enjoys, which reveal the level of authority he enjoys within the system, his relationship with other authorities, and the level of his influence and interaction with them. The research concluded that the constitutional position of the President of the Republic remains the most important at the level of the political system. The President of the Republic, based on his direct election, enjoys unparalleled electoral legitimacy in terms of comprehensiveness and focus, which is what made the constitutional founder place on his shoulders the responsibility of embodying the state and protecting it. The Constitution, ensuring the orderly functioning of public authorities, and in addition to these powers, the President of the Republic dominates and exercises executive power. As for legislative and judicial power, the President of the Republic has powers that extend to both of these powers in a way that ensures his superiority over them.
