المستخلص: تناولت الدراسة التعارض الظاهري بين مفهومي حقوق الإنسان والأمن القومي وبخاصة بعد بروز ظاهرة الإرهاب وضرورة محاربتها. تهدف الدراسة إلى معرفة نقاط التوافق بين حماية حقوق الإنسان والحفاظ على الأمن القومي، ومفهومي حقوق الإنسان والأمن القومي. وتتلخص مشكلة الدارسة في أن هنالك تقاطعات ملحوظة بين مفهومي حقوق الإنسان والأمن القومي، وتظهر بجلاء أثناء الظروف الاستثنائية التي تطرأ على الدولة من وقت لآخر، وتعتبرها تهديداً لأمنها القومي، لذا فالدراسة تطرح التساؤل الرئيس: ما هو التعارض بين حقوق الإنسان والأمن القومي؟ ويتفرع منه ما هو مفهوم حقوق الإنسان؟ كيف نشأت وتطورت حقوق الإنسان؟ ما هي ضمانات حماية حقوق الإنسان؟ ما هو مفهوم الأمن القومي؟ كيف يتم الحفاظ على الأمن القومي؟ كيف ومتى يكون الأمن القومي مهدداً؟. سلكت الدراسة المنهج الوصفي التحليلي والمنهج المقارن. توصلت الدراسة إلى عدد من النتائج أهمها: أن الإجراءات التي تتخذها الدول لحفظ أمنها القومي، كثيراً ما يقع فيها انتهاكاً لحقوق الإنسان. أن حماية حقوق الإنسان والحفاظ على الأمن القومي، تتطلب التعاون بين البيئة الداخلية والخارجية لحماية حقوق الإنسان وعدم التفريط في الأمن القومي. وقدمت الدراسة عدداً من التوصيات منها: ضرورة التعاون بين الذين يقومون بالدفاع عن الأمن القومي والذين يحافظون على حقوق الإنسان من الانتهاك، أن محاسبة مرتكب الجرائم ضد حقوق الإنسان يجب أن تتم في محاكم مستقلة.

The study dealt with the apparent contradiction between the concepts of human rights and national security، especially after the emergence of the phenomenon of terrorism and the need to combat it. The study aims to know the points of compatibility between the protection of human rights and the preservation of national security، and the concepts of human rights and national security. The problem of the study is that there are noticeable intersections between the concepts of human rights and national security، and they appear clearly during the exceptional circumstances that occur to the state from time to time، and consider it a threat to its national security، so the study raises the main question: What is the conflict between human rights and national security? From it: What is the concept of human rights How did human rights arise and develop? what is it human rights protection guarantees What is the concept of national security? How is national security maintained? How and when is national security threatened? The study followed the descriptive analytical method and the comparative method. The study reached a number of results، the most important of which are: The measures taken by states to preserve their national security often violate human rights. The protection of human rights and the preservation of national security require cooperation between the internal and external environment to protect human rights and not to compromise national security. The study made a number of recommendations، including: the necessity of cooperation between those who defend national security and those who preserve human rights from violation، that the perpetrators of crimes against human rights must be held accountable in independent courts.
