المستخلص: لقد خص الله تعالى الشريعة الإسلامية بخصائص عديدة بأن جعلها صالحة لكل زمان ومكان، متجددة بطبيعتها، وهو سر خلودها وكونها رسالة عالمية جاءت لتهدي البشر، وتعالج مشكلات المجتمعات مهما اختلفت الأزمان والأماكن والأحوال، لذا قيّض الله تعالى لها من يخدمها، ويجدد لها أمرها، ويعمل على تقريبها للناس لقوله صلى الله عليه وسلم: "إن الله يبعث لهذه الأمة على رأس كل مائة سنة من يجدد لها أمر دينها". ومن هنا كان التجديد في الدين فريضة وضرورة حضارية للمجتمع الإسلامي، والفقه جزء منه، إلا أنه لا يقصد به الحذف والمحو لهذا الموروث والقطيعة معه، وإنما هو إعادة النظر ومراجعة ما طرأ عليه من المفاهيم الخاطئة، ونفي ما تلبس به من بدع وأخطاء التي بُنيت على تصورات قاصرة، إذ من مشمولات التجديد أنه ينفي الانتحالات، والجهالات، والتحريفات التي يدخلها بعض الناس على الدين وأحكامه الفقهية، انطلاقا من قوله صلى الله عليه وسلم: "يرث هذا العلم من كل خلف عدوله ينفون عنه تأويل الجاهلين، وانتحال المبطلين، وتحريف الغالين". كما أن التجديد بمثابة الحجر الأساس في عملية النهوض بالفقه إلى مصاف الاجتهاد، وبه تصدي العلماء لكل ما تقذف به الأيام من إشكالات، وتعقيدات، ومستجدات ومن خلاله تمكنوا من بلوغ مرتبة التنظير والتقعيد لهذا الفقه، فأسسوا رحمة الله عليهم لهذا التجديد ونظّروا له، بمراجعة الأقوال تنقيحا وتخريجا وتصحيحا وترجيحا، فجعلوه ملائما لعصورهم، ووافيا بحاجات الناس فيها وقائما بمصالحهم، إلا أن اجتهادات علماء كل عصر منها، كانت تحمل في طياتها قدرا من الخصوصية مرتبطة بالعصر الذي مورست فيه، وبالظروف والأحوال التي تولدت فيها، ولذلك لا يصلح لعلماء العصور اللاحقة أن يتبنّوها إلا بعد تنقيحها وفرز ما كان لا يصلح منها إلا لذلك العصر، وتمييزه عما هو مطلق صالح للنقل والعمل به في كل العصور. ومن ثم فالتجديد لموروثنا الفقهي يقتضي إعادة قراءته قراءة تمكين واستخلاف لا قراءة اجترار وتقديس، قراءة يُراد بها إحياء أحكامه في حياة الأمة، وإعادة انبعاثها بروحها التجديدية، ومراجعته مراجعة مستمرة ناقدة بنّاءة، بما يضمن استمرار تجدده ومواكبته للتطورات في كل زمان ومكان، حتى يبقى غضا طريا معطاء كما كان على مر الأيام والسنين.

God Almighty has distinguished Islamic Sharia with numerous unique characteristics, making it suitable for all times and places and inherently dynamic by nature. This is the secret of its timelessness and its universality, as it came to guide humanity and address the issues of societies regardless of the differences in eras, locations, and circumstances. Therefore, God has ensured there will always be individuals who serve it, renew its essence, and bring it closer to people, as reflected in the Prophet Muhammad's (peace be upon him) statement: "Indeed, God will send to this nation, at the head of every hundred years, someone who will renew its religion for it." From this, renewal in religion becomes both an obligation and a civilizational necessity for the Islamic community. Jurisprudence, as a part of religion, is included in this renewal not by erasing or severing ties with the inherited legacy, but by revisiting and reviewing the misunderstandings that have arisen, and removing the innovations and errors that have been based on limited interpretations. Renewal involves eliminating distortions, ignorance, and exaggerations introduced into religion and its jurisprudential rulings, as indicated by the Prophet Muhammad's (peace be upon him) saying: "This knowledge will be carried by the trustworthy of every generation, who will eliminate from it the distortions of the ignorant, the fabrications of the false, and the interpretations of the extremists.". Renewal serves as the cornerstone for advancing jurisprudence to the level of ijtihad (independent reasoning). Through renewal, scholars have addressed the complexities and new developments presented by time. They achieved theoretical and foundational frameworks for jurisprudence, revisiting previous opinions through refinement, analysis, correction, and prioritization, making it relevant to their eras, meeting people's needs, and serving their interests. However, the efforts of scholars in every era carried an inherent specificity tied to the conditions and circumstances of their time. Consequently, later scholars cannot adopt these interpretations without careful revision to distinguish what was specific to that era from what is universally applicable across all times. Thus, renewing our jurisprudential heritage requires re-examining it with an approach of empowerment and stewardship, not blind imitation or excessive sanctification. It necessitates reviving its rulings in the life of the nation, reinvigorating them with a spirit of renewal, and conducting continuous critical and constructive reviews. This ensures that it remains dynamic, responsive to developments, and relevant to every time and place, preserving its freshness and vitality throughout the ages.
