|a الهدف: «دفع الإشكال الوارد في أثناء هذه الرسالة، والجواب عما أورد على كلام الفقهاء حولها». المنهج: قراءة النسخة الخطية، وتخريج الآثار، وتوثيق النقول، مع وضع مقدمة كاشفة لهذه الرسالة. أهم النتائج: ١- أورد المصنف النقول عن تملك العبد، وما يترتب على القول به من فروع فقهية. ٢- اعتنى المصنف بإيراد خلاف علماء المذهب حول هذه المسائل. ٣- سرد المصنف-رحمه الله - ثلاث عشرة صورة من صور تسري العبيد. 4- اقتصر المصنف في ذكر أدلة المسائل على آثار واردة عن عدد من الصحابة والتابعين، واقتصر في النقل عن المصنف لابن أبي شيبة.
|b Objective: To resolve the ambiguities raised in this treatise and respond to objections made regarding the statements of jurists on this matter. Methodology: Examining the manuscript, verifying narrations, authenticating references, and providing an introductory study to elucidate the content of this treatise. Results: The author cited various references regarding the ownership of a slave and the jurisprudential branches that follow from this ruling. He carefully presented the scholarly disagreements within the Hanbali school concerning these matters. The author—may Allah have mercy on him—listed thirteen different cases of slave concubinage. He restricted his citation of evidences to narrations from the Companions and Successors, relying primarily on the work of Ibn Abi Shaybah.
