|a الهدف: جمع المسائل التي أطلق ابن مفلح الخلاف فيها، والوقوف على منهجيته في إطلاق الخلاف، وبيان الصحيح من الخلاف المطلق، والوقوف على منهجية الإمام المرداوي في التصحيح والترجيح. منهجه: المنهج الاستقرائي التحليلي الاستنباطي. النتائج: - أطلق الإمام ابن مفلح الخلاف في عدد من المسائل في أصوله؛ منها مسائل أصولية وأخرى فقهية. - صحح الإمام المرداوي في التحبير كثيرا من المسائل التي أطلق ابن مفلح فيها الخلاف، وترك بعضها من غير تصحيح، وصحح ابن النجار بعضها. - الصيغ التي أطلق بها ابن مفلح الخلاف في أصوله لا تختلف عن تلك التي بينها المرداوي في مقدمة تصحيح الفروع. التوصيات: يوصي الباحث بدراسة أثر ابن مفلح في المدرسة الأصولية الحنبلية، والعناية بأصول ابن مفلح، إقراء، وشرحا، وتعليقا، وتحشية، وتفقير الكتاب وترتيبه، ووضع عناوين جانبية لأهم مسائله.
|b Objectives: -Compiling the issues where Ibn Muflih presented unqualified disagreement (khilaf muTlaq). - Analyzing his methodology in presenting such disagreements. - Determining the correct opinion in these disputed matters. - Exploring Imam al-Mardawi’s approach in correction (Tashih) and preference (tarjih). Methodology The study follows an inductive, analytical, and deductive approach. Results: -Ibn Muflih introduced unqualified disagreement in several issues, covering both legal-theoretical (Usuli) and jurisprudential (Fiqhi) matters. -Imam al-Mardawi, in al-Tahbir, corrected many of the issues in which Ibn Muflih left the disagreement open-ended, while leaving some uncorrected. Some of these were later addressed by Ibn al-Najjar. -Ibn Muflih’s formulations for presenting disagreement in his Usul work align closely with those al-Mardawi outlined in the introduction to Tashih al-Furuʿ. Recommendations: The researcher recommends further studies on: - Ibn Muflih’s influence in the Hanbali Usul school. -Teaching, explaining, annotating, and indexing his Usul works to improve accessibility. - Rearranging and structuring his work by adding marginal notes and side headings for key issues.
