المستخلص: يهدف البحث إلى بيان المآخذ الأصولية للأحكام الفقهية المستنبطة من حديث التفليس، وإبراز أهمية علم أصول الفقه في استنباط الأحكام الفقهية من نصوص الأحاديث النبوية، وقد استخدمت في هذا البحث المنهج الاستقرائي، والمنهج التحليلي المقارن، وتوصلت في هذا البحث إلى جملة من النتائج، من أهمها: أن حديث التفليس حديث متفق على صحته بين أهل العلم في الجملة، وفيه خلاف مؤثر في بعض رواياته، كالاختلاف في رواية الزهري، وأن المآخذ الأصولية هي: الأدلة الإجمالية والقواعد الكلية المؤثرة في استنباط الحكم من النصوص الشرعية، وقد بلغ عدد المآخذ الأصولية للأحكام الفقهية المستنبطة من حديث التفليس ثمانية مآخذ أصولية، منها: قبول خبر الواحد، ومخالفة خبر الواحد تقديم القياس والأصول العامة، قبول زيادة الثقة، حجية مفهوم المخالفة، الخاص الموافق للعام لا يخصص العام، ترجيح الرواية الموافقة للقياس والأصول العامة، ومن أهم التوصيات التي خرجت بها في هذا البحث الاهتمام بالدراسات التطبيقية لموضوعات علم أصول الفقه، وبيان المآخذ الأصولية للأحكام الفقهية المستنبطة من القرآن الكريم، والسنة النبوية؛ لتنمية الملكة الفقهية الأصولية لدى الباحثين.

The research aims to highlight the foundational principles underlying jurisprudential rulings derived from the Hadith of taflis (the insolvent debtor), and to underscore the significance of the science of Usūl al-Fiqh (principles of Islamic jurisprudence) in deducing jurisprudential rulings from prophetic traditions. In this research, both inductive and comparative analytical methods were employed. the study arrived at several conclusions, among which are: the consensus among scholars regarding the authenticity of the taflis Hadith overall, yet with some variation in its narrations, such as discrepancies found in the narration by Az-Zuhri. Additionally, the foundational principles include general evidence and overarching rules influencing the derivation of rulings from religious texts. the research identified eight foundational principles for jurisprudential rulings derived from the taflis Hadith, including: accepting the report of a single narrator, contesting a single report by preferring analogy and general principles, accepting an increase in reliability, the validity of the concept of contradiction, the principle that what is specific and general does not limit what is general, preferring the narrations in line with analogy and general principles, among others. One of the key recommendations emerging from this research is the importance of focusing on applied studies in the field of Usūl al-Fiqh, and highlighting the foundational principles for jurisprudential rulings derived from the Qur'an and the Sunnah, to enhance the understanding of jurisprudential reasoning among researchers.
