The 2020 constitutional reform brought about significant changes, including the transformation of the Constitutional Council into the Constitutional Court. This shift raises the question of the legal nature of constitutional review: does it represent a transition from political control to judicial control? Through a comparative approach, the study reveals that the Algerian constituent body drew inspiration from the Kelsenian model, opting for a hybrid system of review that combines both jurisdictional and political dimensions. This choice reflects the central role of the Constitutional Court: to ensure respect for the Constitution while regulating the functioning of institutions and the activities of public authorities. La réforme constitutionnelle de 2020 a entraîné des changements significatifs, parmi lesquels la transformation du Conseil constitutionnel en Cour constitutionnelle. Cette évolution soulève la question de la nature juridique du contrôle de constitutionnalité: s'agit-il d'un passage du contrôle politique au contrôle judiciaire? À travers une approche comparative, l'étude révèle que le constituant algérien s'est inspiré du modèle Kelsenien, optant pour un système hybride de contrôle qui combine des dimensions juridictionnelles et politiques. Ce choix incarne le rôle central de la Cour constitutionnelle: assurer le respect de la Constitution tout en régulant le fonctionnement des institutions et l'activité des pouvoirs publics. |
