المستخلص: IT is without doubt that the first important is to secure the Justice punishment and then to secure the function of the Justice punishment The legality rule dose not differ in meaning with Islamic law whereas the foundation from the forward meaning in the position law. It means that the punishment and even the Crime depend on the versions of the Islamic law and its Sources. Today it is known as the rule of the Criminal legality, which means that no punishment, no Crime with out aversion. This rule Settled at modem legislations even it is on Constitutions level or on the Criminal laws: and without this legality the punishment becomes on instrument of violence and revenge. The Islamic law: the Sharia knows the applicclions of this rule for Centuries Inspite of it is not known with its clear scientific form, except England because of the puplication document of the great Testament which John the king gave to his guardians in England It is considered as a gift after along discord with the nobles in 1216. So the Rule was known in U.S.So they included within the human rights announcement, which came out in 1772 and then it was depended by the men of the French revolution, and they gave it clear drafting, and limited through the human rights announcement in 1749. So it was depened by the leaders of the revolution as one of the warranties of the individual redound liberty inorder to be aware to research this rule Through the Sharia: We divided the study of this subject for three requirements. In the first requirement we take the Rules Legitimacy through the Islamic law. In the second requirement we take the main indications of this Rule and in the third requirement the main results of this Rule.
