المستخلص: The philosophy of the punishment and its targets has passed in many historical stages that the punishment transferd as a means of revenge from the criminals to a means of correction. The philosophical schools in punishment have been passed through many stages.Start with the first classical school which foucused on the criminal punishment function.While the other modern classical school foucused on the equality of the punishment function.While the positive school considerd the criminal don’t have a choice’obliged’ when he commited a crime .The philosophical school ,which represented by the (The movement of modern social defence ),that araised in the middle of the twenteenth century and it confirmed on the necessity of the correctional policy to the criminal and respect his dignity according to the human beings elements through avoiding the hard punishment and blaming him. The most famous philosophers whom advocate the philosophy Professore (Gramatica) represent the extreme side of the movement and (Mark Ancel) represent the moderate side. In order to show the exact meaning the modern movement of social defence, its philosophical ideas and its results, we divided the subject of the study into five sections.The first section to explain the meaning of the (Social defence). The second section to the social defence in the conception of (Gramatica). The third to the conception of (Mark Ancel). The forth to appreciate the ideas of Gramatica and Ancl. And the fifth section to the programme of miniumum limits to the movement of modern social defence.
